Oh well the grand old day has come for me and the boglins to take a trip to the court and file against the Wooly Monster!!
Since this process started, my account went £320 overdrawn in charges, sweet, and Lo and behold despite doing my paperwork last night, I had a letter off them this AM saying another £93 has been added to my account at a rate of £3 per day whilst my account is overdrawn.
Now I prepared to add this to my claim up until today, but is worth putting on my MC an extra section to state that I will be claiming in addition, the charge of £3 per day that they leving on my account whilst the claim is being processed!!
Judging by the length of time my other claims have taken, this little £3 will run into the £100s by the time is gets settled!!

Yeh So did I!!!!
Its gone now so too late anyway!!!
Ive had soooooo many letters off these burks so far all from different people all from different addresses!!!
They think they can fob me off by confusion, they underestimate me as I have been through a claim with Cr*pWets, and they are the Joint Crowned Kings (along with Abbey - thankfully not had to claim against those as well) of dogdy deallings and smoke screens!!!
How far are you with your claim?

Oh well quickie update on the Wooly monster.
Had letter off them two days before N1 was filed.
In the letter it referred to two deafults they had registered with CRA (really thats the first Ive heard of it).
In a nut shell, one is for the charges as detailed above (what despite breaching the baking code re disputed accounts, and the Section 12 of the DPA notification to desist in processing my info) and the other default from back in Jan.
To cut a long story short.
Needed the Account to remian dormant whilst I was on Mat leave so went into the branch in person to cancell all DD, even had confirmation off them.
Anyway they still allowed 3 to continue. As you can imagin 3 dd being bounced and then reclaimed after 14 days and bounced again, plus Wooly £3 overdrawn per day charge it didnt take long for this £0 account to end up pretty badly in negative balence. After 3 months worth of compliants and a negative balence of £753 - all charges, wooly finally admitted liabilty and canclled out the charges!!!
Well, I see that was not the end of it and as a direct result of these court proceedings, they had retrospectively registered the default for me (where are my two default notices then - wooly!!!!)
So yesturday spent the best part of the day typing two letters to FSO and ICO to complain about these pests!!!!!
Sent a letter back off to the Wooly explaining my actions..........watch this space!!!!
Defaults they are the bane of my life!!!

Had another letter off the wooly now saying my account is now £429 overdrawn. I have not used this account since my prelim went (account at £2 in credit balence) in and they slapped £90 worth of charges onto the account, then coupled with £3 per day for being overdrawn plus their interest you can see how in a few short weeks they have turned a £2 balence into a mamouth debt on an account that is not being used!! WHY!!!!!!!!
Also They said that they defaulted me when is was £320 overdrawn (no default notice) and now they have stated that if I dont bring the balence back into credit they will default me agin!!!
I know that the acount is getting further and further into debt but as I can not afford to pay it all back how can I stop this machine continually defaulting me this is third time theyve done it so far.
I have sent them the DATA Protection notice, also Ihave complained to FSO and notified the Wollwich of this complaint. And they dont seem to care!!
Ive been advsied that I can sure them for theextra charges these default will incurr inmortage repqyments but to be honest why the heel should Igothrough the courts again!!
It makes me sick that they can just act like this causing so much stress in peoples lives without a care. And who listens - no one!!!!!!! Thats who!!!

You know the courts are bogged down they will just say 'its probably in the court but has'nt been logged yet'.
My one for a CC (monument) (a Barclays t/a co.) was almost 2 weeks late being 'Logged in the courts system' the woman on the phone even asked is this a 'claiming back bank charges thingy' as tho were causing all the probs. I felt like saying at least it keeps you in a job.
Sorry to be the bringer of bad news.
Hope your Mat leave is ok.
And dont get too stressed.

Spoke to the courts - The wooly have written to them stating that the papers were served to the wrong address and therefore require more time to repsond!
Papers were served to their "Churchill Place" Addy, anyway in a nutshell they have been given until the end of Dec to respond.
I think this is absolutly disgusting stalling tactis on their behalf and I think when I get the paperwork Im going to wirte back to the court infroming them of this.
As for my clerk at the court she wanted to know how I knew all this info about charges, so I mentioned CAG and she said she would like the web addy as she is going to make a claim as well as she was really sick to stomach of banks and their charges. She had just paid £3K to change mortgages and was fuming!!!

The word your looking for is BANKERS as in they are a load of Bankers and the courts well i would'nt say they were one sided but i was told 'your cutting fine by handing in a aq with 3 days to spare,' to which i replied well i only recieved it yesterday so i think i have done quite well, and i have been phoning you and the only answer i got was it might be here just not logged yet.....' But the other bankers , well they can just say never got it!

yep me too - three days to spare well what about the banks submitting their 3 weeks after the deadline!!!!!!!
You right makes me flipping sick as well - I think the courts are really peeved with it all but they seem to be taking it out on the claimants rather than the banks who are hogging up the systems!!

Ok heres what happened today:
Great old Gorden Jennings called (he the only chap in the whole of the Wooly/Barclays dealing with my case remember)
Said I have nothing further to add from my letter stating I have no record of your litgation proceedings so we are starting recovery action on your account!!
So I went into a speal about them acting intimadatery and how do they think the court are going to like the fact they cant find my paperwork regarding action 3 days after they have submitted a defence blah blah blah.
He asked me to send him my paperwork I told him that as I was suing them - I was not about to do their work for them!!!
Anyway I went out and when I came back dah dah letter from court re woolwich.
In their letter they state to the court that as they were served at the wrong address they only just got the issue not and request a further 28 days to file their defence. The court has agreed to this.
New address for correspondence to the Woolwich enclosed.
Does anybody want to guess what the difference was in these addresses which warrents an extra 28 days??????

Spoke to a lovely woman!!!
Anyway she was ok to confirm all legal proceedings will be stopped against me. I asked if they had recieved their notice of transfer regarding the CMC conf in Cardiff and you could hear the fear in her voice, she quickly said that they didnt want togo to CMC and she felt that things would be "settled" before the transfer took place.
I said oh its already happened and the paperwork should be on its way to you and you almost heard the phone fall to the floor.
Anyway she is going to phone the courts and give me a call back with the next day or so!!!
So we'll have to wait and see then peeps!!!
