I have contact them sending at least 5 emails before i default on my loan.

 

 

I have cancelled the cpa with the bank and with Uncle Buck who have acknowledged the cancellation.

 

 

However i have made a reasonable offer of £40 per month and asked them to cancel charges and interest in order for me to clear the debt.

The debt is for £316.

 

 

They are completely ignoring my emails.

They also called me at work a couple of days ago and went through the receptionist a

nd told them they were from Uncle Buck so now the receptionist at work knows that i have debt with them.

 

 

I told her under no circumstances to call me at work ever.

 

 

I also emailed them to only contact me by email.

 

 

They are just not responding.

 

 

Shall i just pay the £40 each month?

You need to write to them and tell them. Dont phone them. Ever.

Then time to make it a formal complaint and get the FCA involved.

Edit it to suit your needs. You might want to add a line or two "Removing any permission explicit, implied or otherwise given for contacting you at your place of work"

 

Send it with proof of posting, available free from your local post office.

 

If they continue after they receive this then you would be free to begin your complaint to the FCA and FOS

Would you be able to advise on payment. I have made a suggestion of £40 per month and requested that they freeze interest and charges to enable me to clear the debt. They haven't advised either way. Should i just pay it?

You work out your I&E then send them an extremely simplified summary of it. You then tell them what they are getting. They do not get to tell you. Infact, you dont even need their permission. You work out what you can afford, tell them, then start paying via standing order. They also cannot refuse to give you bank details etc as they arent allowed to refuse a valid payment towards a debt. If they try and refuse, you can use the good old postal order method.

Many thanks for your advice

 

I have been given bank details and set up a standing order. I will start paying shortly. I am just confused as to why they aren't acknowledging my requests. It seems a little unreasonable as i am not trying to avoid paying them. I am also having issues with Paypal. I owe them £251 and they will probably just take it when i have funds in my account and i cant seem to stop it. This will leave me in dire straits. I have cancelled the direct debit and ordered a new debit card. I have also contacted Paypal to request that they hold off trying to take any funds and that i will pay a nominal amount each month. They too are ignoring my emails and my bank wont seem to do anything to stop it except send me a new card. Can they still take payment off a new card with a different card number? I have done a little research and it seems they may be able to?

 

PS. Very grateful for any advice.

Theyre one of the bottom feeders of the PDL world. They dont care about rules, procedure or regulation. They just see you as an easy way to get money. For paypal, demand your bank blocks any transaction to them. They cannot say no. Cancel the transaction, block futureones and cancel any and all cpa's on your account.

Telephoned the bank and they have refused for the third time to block payments to paypal. Contacted paypal and they refuse to talk to me about paying in smaller amounts and said they will take the full amount when it's there.

You need to listen to advice regarding doing a formal complaint.

 

Phone people will not be helpful, they have a script to run from and are not adequately trained in the regulations.

When you give your credit or debit card details to a company and authorise them to take regular payments from your account,

such as for a gym membership or magazine subscription,

it is known as a ‘recurring transaction’ or ‘continuous payment authority’.

These are often confused with direct debits, but do not offer the same guarantee if the amount or date of the payment changes.

In most cases, regular payments can be cancelled by telling the company taking the payments.

However,

you have the right to cancel them directly with your bank or card issuer by telling it that you have stopped permission for the payments.

Your bank or card issuer must then stop them – it has no right to insist that you agree this first with the company taking the payments.

Regulator orders Banks and mutuals to review complaints about not cancelling recurring payments from November 2009.

Consumers who have set up a regular payment from their account will now be able to successfully cancel that arrangement

by contacting their card provider, the Financial Conduct Authority said.

The FCA has been examining how easy it is for customers to cancel Continuous Payment Authorities (CPAs)

due either to payday lendersicon or for other regular payments such as subscriptions or gymicon memberships.

CPAs, which are also commonly called recurring transactions or recurring payments,

are relatively easy to set up but can be hard to cancel, causing problems for consumers trying to manage their finances,the FCA said.

.

Now, following the FCA review of how the largest high street banks and mutuals process requests to cancel CPAs, they have agreed that they will ensure that when

a customer asks for a recurring payment to end, that will be sufficient to cancel the arrangement. They have also confirmed that should a payment go through by

mistake following cancellation by a customer the customer will be refunded immediately.

In addition to securing this commitment, the largest banks and mutuals have agreed to review every individual complaint they have received about the non-

cancellation of a CPA and to pay redress where payments have continued to be made despite the customer cancelling the arrangement. This applies to all complaints

since November 2009 when the Financial Services Authority, the FCA’s predecessor, began regulating banking conduct.

Clive Adamson, the FCA’s director of supervision, said: “It’s important that consumers are confident that banks are meeting their everyday banking needs. Today

customers can be confident that when they ask for a Continuous Payment Authority to be cancelled – it will be cancelled - and that it can be done easily.

“We recognise that historically this is an area where some customers have struggled but the banks and mutuals have responded positively to our work on this issue.

From now on we expect them to be getting this right. In addition, they have committed to review past complaints.”

Also mentioned your displeasure that as whomever took your money had obviously attempted this many times

probably activating your banks own anti fraud software - nobody had the decency to inform my you this was going on.?

How quickly must my bank refund me for an unauthorised transaction?

The bank must make the refund immediately unless it has evidence that one of the above reasons applies.

Your bank may ask you to answer some questions and fill out a form confirming what has happened,

but it cannot delay your refund while it waits for you to return the form.

If the bank has evidence that one of the above reasons for refusing a refund applies,

it may investigate before making a refund

but must look into it as quickly as possible.

If your bank rejects your claim for a refund it should explain why.

If the transaction was on a credit card, the refund may not happen immediately.

But the card issuer cannot charge interest or ask for repayment of the amount unless it can prove you are liable to pay

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
