Hello All,

 

Name of Claimant: Capquest Investments Limited

 

Date of issue – 12/02/2015

 

Defence – NOT YET SUBMITTED

 

 

What is the claim for – the reason they have issued the claim?

 

The claim is for the sum of £13K in respect of monies owing by the defendant

on a credit agreement held by the defendant with Lloyd Banking Group

under account xxxx Upon which the defendant failed to maintain payments.

 

2. A default notice was served upon the defendant and has not been complied with.

 

3. By virtue of a sale agreement between Lloyd Banking Group and the claimant,

the claim vested in the claimant who has a genuine commercial interest

The defendant has been notified of the assignment by letter.

Did you receive a Default Notice from the original creditor? NO

 

Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? No

 

Why did you cease payments? Financial Difficulty

 

What was the date of your last payment? October 2009

 

Was there a dispute with the original creditor that remains unresolved?

NONE

 

Did you communicate any financial problems to the original creditor

and make any attempt to enter into a debt mgt plan? YES FEB 2009

help needed i dont know how to tackle this one can someone please help me

checked cra and its registered against me, need to know how to defend this one please

im not sure if this will be SB

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Timeline..

 

Date of issue 12.02.2015 + 5 days = 16.02.2015 + 14 days to acknowledge = 02.03.2015 + 14 days to submit defence = 16.03.2015.

 

You have until 16th March to submit your defence so you have a few days yet. Have you acknowledged the claim online ?

 

You advise that you made an attempt to enter into an arrangement with LTSB - what happened ?

 

If your last payment was October 2009, then this account will not be statute barred yet.

 

Did you send a CPR request to the solicitor named on the claim form in order to obtain information.. such as copies of the default (do you know what date it was supposed to have been issued ? ) Do you know when the claimant purchased the account ?

made paments upto October 2009 due to fiances issue unable to committ

no idea!!

 

 

just received CCJ only

 

 

loan was unsecured PPI was claimed back last year
