Hi guys what it is im with the Abbey bank,i overdrew by £5.65 and they want me to pay £50 on top why is that??also this has hapened quite a few times.So im wondering if i can claim all this money back?and how if i can?i have read the forums but i dont understand them properly.Any help would really be appreciated.

They want you to pay the £50 because they are greedy.
Yes you can claim it all back but it's a process that can't be rushed and has to be followed properly, and done correctly.
If you have all your bank statements going back 6 years (some people are claiming further back but that's a different thread) you can highlight all the charges and the interest they have charged you.. and copy it onto a spreadsheet found on this site in the bank templates library.
If you don't have your statements you can send a SAR letter (also in the templates section) with a cheque or PO for a tenner and within 40 days you should get your statements (note 'should' - sometimes banks make it difficult).
Then you send a pre-lim letter (again in the library) .. wait 14 days...
... then a lba... (already written for you here on this site)...
then wait another 14 days (u may or may not get a response)..
then file with the local court... then you will prob get your money within 28 days ish!!!

NEXT - sent CCA request - 15/01/09 - not received
Capital One - sent CCA request - 15/01/09 - received CCA and also offer of £67 which I am not accepting.
NatWest - sent s.77 letter complaining about default on file 15/01/09 - *WON* Default removed within a fortnight!!
NEXT - 7/02/09 - sent further letter reminding them of breach of DP
Cap1 - 7/2/09 - Accept part payment/reminder of default to be removed
Yep Jessica. Cut and paste that letter form top to bottomm putting your own details in (i.e. Address, a/c number, etc...). Include the bold lettering at the top. Make sure you sign it! and send a cheque for £10. It never hurts to take a copy into your branch, email them or send it recorded delivery. Good Luck.
