      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Lenovo says it is changing its ways:

The events of last week reinforce the principle that customer experience, security and privacy must be our top priorities. With this in mind, we will significantly reduce preloaded applications.

 

 

Our goal is clear: To become the leader in providing cleaner, safer PCs.

We are starting immediately, and by the time we launch our Windows 10 products, our standard image will only include the operating system and related software, software required to make hardware work well (for example, when we include unique hardware in our devices, like a 3D camera), security software and Lenovo applications. This should eliminate what our industry calls “adware” and “bloatware.” For some countries, certain applications customarily expected by users will also be included.

 

 

Lenovo will post information about ALL software we preload on our PCs that clearly explains what each application does. And we will continuously solicit feedback from our user community and industry experts to ensure we have the right applications and best user experience.

 

 

We view these actions as a starting point. We believe that these steps will make our technology better, safer and more secure.

That's quite a turnaround, especially when you compare it to their original head-in-the-sand position of thinking people were just grumbling about the irritating adverts that Superfish-afflicted Lenovo computers were displaying, rather than the serious security and privacy issues the software introduced.

 

 

If they're true to their word, and chuck out the adware and bloatware, and don't try to sneak it in under the umbrella of "certain applications customarily expected by users" then they are doing all of us a favour.

 

 

In fact, I'd like to see other PC manufacturers take the same approach.

Stop putting crapware on the PCs you're trying to sell. Let users make their own choices about what software they want to install, rather than you forcing software on them that takes up unnecessary disk space, hogs memory and invariably is only there to bring incremental revenue to the vendor.

Lenovo, you better be telling us the truth. We'll be watching you.

Errrmmm.... So they are providing something called "Windows 10" - Surely this is bloatware in a class of it's own ?

 

When Lenovo can provide me with a product where the operating system occupies less than 1Gig of disk space, I might consider it.

1gb is nothing. I know of a single online game that is an 8gb download.

As time progresses, it has to increase in size for all the security, saftey and user wanted applications.

You can get several Linux distros that are way under 1 Gig, complete with office apps, and you can install Steam and play games on many of them.

 

many will run straihgt off the USB pen like Puppy.

Yep been there and done that. I dont like Linux. Also, the last Linux operating system I used(work pc) was under a gig, but not by much.

My point is that in this day and age where pcs routinely come with 1+terabyte, why should 1 gb be an issue. 1/1000 of the drives storage space isn't really going to be an issue.

And its only £70 for a 1tb usb3 external hard drive if you want more fast access storage.

Its only an issue when you try to install a new OS on hold hardware.

Windows will also run brilliantly from a usb pen.

Each system has its own pros and cons, and I'm not knocking Linux, I just dont get on with it.

Each to their own, there are some nice dual boot Android/Windows 8.1 8" tablets out there with 2 gig RAM, and 16 or 32 GB storage so that version of 8.1 must be quite lean. Yes really an OS taking a gig is neither here nor there today, but I don't like Lenovo and won't buy a lenovo machine.

After being a Windows fanboy since 3.1, I am now a Linux convert. Was using XP, tried Vista but didn't get on with it so when XP expired, tried a few Linux distros to see if there is anything I liked. I dual booted windows and a distro called LXLE http://lxle.net/ for a while and found I was just using LXLE all the time. Its runs a lot better than windows ever did and does more than I need (has many programmes preinstalled such as an Office Suite). For anyone watching the pennies, in my opinion it is the perfect solution to avoid getting caught up in the upgrade money pit of proprietary software. You don't need to get a better laptop/PC with a more powerful processor, more memory or a bigger hard drive. Its free to download and use and will forfill the needs for the majority of users. £70 for an external USB drive may not seem like much to some, but for others its a weeks food bill!

China with it's sweatshop, China that produces more dangerous counterfeit products than any other country. China with it diabolical human rights record.

Human rights in China have improved a lot. China is not a sweatshop anymore. India and Bangladesh are. 90% of products sold in UK are either made in China or assembled with parts imported from China.

 

The PC you have typed your post from is made in China. If you really want to be consistent with your statement, you should avoid all electronics and live a very frugal life. Then I could take you seriously.

If you are going to split hairs, I avoid when I can, I've not said I don't buy or own anything Chinese.

 

 

Sweatshops have not gone, we saw the apple sweatshop on the tv just a few weeks ago. Granted some are improving conditions, but that's only the ones we hear about.

It wont be long before we have paid all our money to china and other developing communities to improve their conditions and pay and then, we will not longer be able to afford the items as there prices in line with the costs would have risen ten fold while our income over here would have stayed the same.

We would be unable to produce the items of specialist electronics ourselves as we would have spent all our money improving conditions over there and have none left to get our industry off the ground again and nor would we have the skilled labour to do it. It wont be long before an iphone will set you back thousands. And there will be nothing we can do about it. We will just fade from the global scene until we become a third world country ourselves. And I wonder which of the nations that we have helped to develop will come to our aid then. Yep, thats what I though. None of them. I dont mind helping a country in need. But come on, some of these countries have more than us and yet we fork out to pay for them to feed their citizens while they spend their budgets on warships, fighter planes, nuclear weapons and god knows what else. Sick world indeed.

well an ipad is a popular present in china - proving once again the best present is always something you kid made

China has stricter laws than 15 years ago. I doubt that a child could work legally in China. I don't rule out that a few work illegally. Again, if you want to boycott Chinese products, feel free to switch your PC, router, mobile phone and tv off.

China has stricter laws than 15 years ago. I doubt that a child could work legally in China. I don't rule out that a few work illegally. Again, if you want to boycott Chinese products, feel free to switch your PC, router, mobile phone and tv off.

 

never said i dont buy chinese, get alot of stuff imported directly

ive 16gb space on my computer and to update from windows 8 to windows 8.1 will take another 3.62 gb! that is nearly 25% of my entire storage, just for an update!

 

any added bloatware would kill my pc.. hopefully lenovo stick to what they promise
