      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

 

I have been following this forum for a couple of months now and it gave me the confidence to pursue my own PDL claims so I thought I would let you know my success as it is the success stories that keep me going!

 

I had several PDLs with a number of companies whilst I was at uni for a few years. After reading on here I started contacting them one by one as advised and began receiving either write offs of small balances (500/600 ish) and about 4 refunds from others for about 200/300 which I accepted as I only had a small amount of loans with each company.

 

My biggest lender was Wonga who loaned me around £20k over 3 years and I actually decided to use a claims management company to pursue this as I thought they would take the claim more seriously and I would get paid out quicker. I considered my claim clear cut as I was continually loaned and rolled over 1k with repayment of around £1,470 each month despite wonga knowing my income to be £1,150.

 

I chased them weekly and so did my claims manager and today was the last day for the 8 week reaponse. I expected nothing and received an email asking for an additional 6 weeks to consider my complaint. However, about 15 minutes after I was emailed again from another department offering settlement of just under £7k wich I have accepted. I spoke tk them this mornkng to provide details and was advised payment would be made in 3-5 days buy whether that happens Ill let you know. I am assuming they pay quicker where it is settlement on their terms as opposed to being forced to by the ombudsman but ill let you know.

 

My final claim is with QQ where I am trying to have my balance written off and they have 3 weeks left to respond.

 

Like most of you I lived in fear for nearly three years and so it really does feel like justice. All the best to everyone else making claims and like many have said the more that so will not only find themselves better off financially but also put the lenders in the same dire situations we have all been forced into.

This story is amazing. Just goes to show that these companies definately DO NOT lend responsibly and only care about the £££'s.

Thanks Mrst and congratulations to you too with the adjudicator upholding your complaint fully. I was advised it was likley that I would get all loans refunded (amounting to about £10-£11k) but that it would be a long drawn out process and of course I may lose all together (even if it is unlikely)

 

just in terms of an update the funds actually hit my account this afternoon having spoken to Wonga at 10am!

Well Done, that's a brilliant result.

 

A quick update on my complaint against Psyday Express. They offered £500 as a gesture of goodwill even though they rejected my claim. This was only a 1/4 of the interest. I rejected it and submitted it to FOS about a month ago. Had a call on Monday from the adjudicator, he asked for my bank statements and I had to fill in an I % E form. He called me today to say Payday Express have made an offer of £2000 which I have accepted. Very impressed with how quickly this was resolved once it went to Ombudsman. They have 28 days to send the payment.

 

Advice to anyone out there in same situation. Keep plugging away and don't accept lower amounts if you think you have a good case. Just waiting for a final response from Lending Stream then I'm done with these companies forever. First time in my life got a healthy bank balance.

Anyone have any links or anything at all to help get me started challenging Wonga, QQ, P2P, 247, Diff Money, 118, Sunny, Mr L? If so I'd be very thankful. I have the feeling from reading these threads that the majority of these lenders didn't follow the right checks and guidlines when issuing the loans.

By the time I came to my senses I had 10 payday loans and didn't think I would ever be able to get out of it. I requested repayment plans with all of them stating I could not afford to keep paying the interest. I did eventually pay them all back, took me about a year. It was only after Wonga decided to write off all those loans last year that I seriously started to think about complaining about irresponsible lending with the help of this forum. Your situation is slightly different to mine in that you still have your loans ongoing. I would start by e-mailing a formal complaint to each company stating that they were irresponsible in their lending to you and that the loans should not have been granted due to your other financial commitments against your earnings and request that the loans be wiped. Below is an example of the e-mails I sent, obviously you would need to tweak to your own individual circumstances.

 

 

 

Good Afternoon

 

 

I would like to make a formal complaint regarding the payday loans I took out with xxxx from November 2011 to November 2013.

 

I feel that sufficient credit checks were not performed and if they had been you would have realised that these loans were unaffordable to me.

 

 

I was already in a cycle of payday loan debt when I took out my first loan in November 2011 and had loans with 4 other payday loan providers totalling approximately £2500, my monthly salary at this point was £1260.00. I also had a bank loan and various credit cards.

 

 

I continued to take out loans each month for 2 years, often receiving many e-mails per month offering loan extensions and further funds.

 

 

By the time I took I the final loan in June 2013 I had 10 payday loans and owed approximately £5000. I have done a quick calculation and worked out that over a 2 year period took out loan in excess of £2500 and repaid in excess of £4500.

 

 

The continuous loaning and reloaning caused me to take out further loans just to pay the interest,.this caused an enormous amount of stress to me at this time and was detrimental to my health.

 

 

While i accept that I applied for the loans I believe that you as a responsible lender should have done sufficient credit checks to see if they were affordable to me which they clearly weren't.

 

 

I would request that all interest paid should be refunded to me. I realise you have 8 weeks to give me a response to my complaint after which time if no satisfactory response is received I can take my complaint to the Financial Ombudsman.

The key thing is if the lenders asked about your expenditure before lending. I think most lenders have been doing this for about a year. If they asked you for this and you gave information that suggested it was affordable you wont win no matter what.

I have read this thread with interest over the past few months and it has spurred me on to take on a few of these companies myself.one of which was VAROOMA whom I took a logbook loan out with and paid back over £6500 on a £3000 loan.I complained about both the charges and interest on a miss selling basis.At first they have rejected my complaint but offered to write off the remaining £220 balance, I then went back and they have now agreed redress of £273 and written off the £220 also.I am not sure whether to accept as I can find very few cases on FOS website and am not sure of my chances of successANY ADVICE PLEASE

many thanks will do.Also happy to share my success so far.I have followed the examples given and cmplained to 11 dayday companies.first response from Lending stream who replied very quickly and have refunded £600 after i pointed out they had failed to send me a default notice and also delayed speaking to me about my default. Was really suprised by the speed of response from them although they are pretty useless at administering there customer services.and certainly when you speak to them they have no idea.Have had a rejection from WDA but now with FOS.Awaiting response from 7 others

Sounds positive - it does make you think, if they had applied the same level of diligence to their lending as they have to this situation, then things all round would have been far better.

I sent a formal complaint to QQ citing irresponsible lending etc but got fobbed off with two replies showing me the credit checks they were supposed to have done at the time and mentioning the electronic contract that I had agreed to via email. Is there any other angle to go at? I have an outstanding balance of £1200.

in same boat with QQ - by looks of it they did do some checks as they are hardly ever mentioned. That said, credit checks are only one of the measures they should undertake - they should look at pattern of borrowing as well. In my case, I believe there were excessive rollovers (over 15) and amounts equivalent to over 50% of my monthly salary. Even if not successful, it is worth going to FOS as it costs quickquid for every case that is lodged - more pressure that is put on these lenders the better

Hi Everyone,

 

I have complained to the FOS mainly on the same grounds of most people here that Wonga was irresponsible in its lending to me in '09-'10 by not conducting proper checks and loaning 11 loans over 9 months for ever increasing amounts. I also had loans from a couple of other lenders which I am waiting for a final response from. I will keep everyone updated as things move on. Quick question though, I complained to the FOS on 14th May and the adjudicator emailed on the 20th May to say that she has requested information from Wonga. The adjudicator called on Thursday to say that Wonga had not replied to any of her messages and asked if I could send more details such as loan agreements etc... to speed things up. My question is how long does Wonga have to respond to the adjudicator, on the phone she did say that there have been cases where Wonga have not responded at all for some cases and they have to push on with decisions without any contact from them.

Hello, I have recently emailed my complaints to Quick Quid/Lending Stream/Wonga/Sunny on the basis of irresponsible lending. I have very similar cases to a lot of people on here who have been successful so I am holding out hope that it goes in my favour. I have repeatedly borrowed from Wonga and quickquid for years, sometimes multiple times a month,often more than my available income and sometimes by rolling over or topping up loans. I have always managed to make the payments by juggling various PLD. There is clear patterns in my loan history of borrowing more than i can afford, repeatedly borrowing and obvious signs of irresponsible lending. I was just wondering what peoples thoughts are and if anyone has any similar stories from these companies of success or failure. I would say i probably borrowed around £14000 form quickquid, they declined my request for compensation but i have forward this to the FOS who are currently looking into it and i wll apparently receive a letter this week according to the lady i spoke to on the phone. I am not sure how much i borrowed from Wonga, they said they will get back to me within 8 weeks, i have requested my account details in the meentine so will forward this info onto FOS if the reponse is a decline. Received email from QQ today with an attachment claiming that they did the required affordability checks with CallCredit and mentioned consumer credit agreements from each loan. Any suggestions?

 

What was the outcome of your QQ case, did you take it to the FOS? Apologies if you have written this already. Thanks

Well done for holding out for the full amount.

 

I received a letter from Payday Express outlining the refund and said I would receive it in 5 working days. On the 5th day I rang them to say I hadn't received it. They said it needed further approval due to the amount. I did receive the money the next day so its,worth chasing if you don't receive it in the timescale they set out.

Hi skintsid.

 

Sounds like you have a good case. I had multiple loans and took out more just to keep up with the interest payments and for the ones I took to the Ombudsman they seemed mainly interested in whether the loans were affordable so asked for copies of bank statements. Once I sent them I received offers fairly quickly. Wonga did pay out eventually without going to Ombudsman but they do seem to take their time.

Hi yes I'm glad I held out extra 6 weeks or so should receive just over a grand so well worth the wait than accepting 225 pounds as they thought they good fob me off thank you

I complained 5 weeks ago to FOS and I spoke to the adjudicator today. She said that that Wonga haven't replied to her request for information so she is giving them one more week at which point she will set out her views and escalate to an ombudsman. Will keep everyone updated.

Sent e-mail to Wonga. Received response the same evening, telling me that they will "review the affordability of the loan(s)" and respond within the required 8 weeks.

 

Have they adopted a new strategy?

So the adjudicator has issued her view of the complaint to Wonga. Wonga haven't responded to any of the requests for information so she has issued view based on what I have submitted (bank statements, income expenditure, other payday loans etc...) It's clear the loans were not affordable, however I was wondering if somebody who has won a case with FOS could advise.

 

On the last loan with Wonga I defaulted and this was subsequently sold on to a debt collection company. However the adjudicators recommended that Wonga repay all the interest and charges paid on the loans. However I have noticed different wordings in FOS decisions. Some say "interest and charges paid" and some say "interest and charges applied". Obviously these are two different things and important because the interest and charges applied to the last loan I took out with Wonga would more than cover the outstanding debt, however these were not actually paid by me to Wonga, but applied to the loans which were then sold on. I was wondering if anybody knows if the FOS mean the same thing when they say "applied" and "paid" because if they mean paid to Wonga I am still left with an outstanding loan which has been sold on with over £1100 worth of interest and charges.
