    • Well tbh that’s good news and something she can find out for herself.  She has no intention of peace.  I’m going to ask the thread stays open a little longer.   It seems she had not learned that I am just not the one!!!!  plus I have received new medical info from my vet today.   To remain within agreement, I need to generally ask for advice re:  If new medical information for the pup became apparent now - post agreement signing, that added proof a second genetic disease (tested for in those initial tests in the first case but relayed incorrectly to me then ), does it give me grounds for asking a court to unseal the deed so I can pursue this new info….. if she persists in being a pain ? If generally speaking, a first case was a cardiac issue that can be argued as both genetic and congenital until a genetic test is done and then a second absolute genetic only disease was then discovered, is that deemed a new case or grounds for unsealing? Make sense ?   This disease is only ever genetic!!!!   Rather more damning and indisputable proof of genetic disease breeding with no screening yk prevent.   The vet report showing this was uploaded in the original N1 pack.   Somehow rekeyed as normal when I was called with the results.   A vet visit today shows they were not normal and every symptom he has had reported in all reports uploaded from day one are related to the disease.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

was in my local tesco earlier, minding my own business in the biscuit aisle when i felt something smacking me on the back

..turned and looked around to see 2 pieces of the concrete roof on the floor so thats what hit me,

must have fallen a good 50 feet. each bit was about 10cm x 10cm.

 

told a member of staff and the checkout lady and

she got he manager and assistant manager,

they logged it over the phone in the accident book

and i spoke to the person that logged it.

 

i already have something wrong with me that the consultants have yet to diagnose

but im under orthopedic care that causes me to be in pain every day ranging from moderate to the point where i have to crawl out of bed.

 

today was an okayish day but since it happened ive been in agony again and ive had to get my crutch out again to support myself.

 

i also suffer from anxiety so when they were all fussing i was trying to hold it together

and not have a total meltdown but i was sweating,

had the shakes, heart was racing etc

i was so warm i looked like a tomato and that didn't go for a good 2 hours after it happened.

 

they paid for my taxi home and she handed my a giftcard,

never offered it just said here you go and to be honest i just wanted out of there,

like i said i didn't want to have a meltdown in front of every one.

 

i dropped the CEO an email and tweeted them ,someone is going to call me tomorrow after 11.30

but someone said because i 'accepted' the gift card they will not offer anything else?

 

dont really feel comfortable going back in there now either.

not true, there's nothing in writing to say that that was a settlement for any claim.

Im guessing there's nothing in writing to say you accepted it at all.

That's what I thought, if I had been about 1cm to the left it would have got my head.

 

I've been bored all day in bed and got thinking,I wonder if they knew there was something wrong or had previously wrong and not repaired right.

 

When the lady escorted me out the store she jokingly said 'oh maybe we will get our refit now'

 

I spoke to them earlier and they said I can make a claim,just have to write a letter to them and use their in house lawyer people or get someone to do it.

 

Dunno if Id trust in house but can i really grudge paying someone a fee lol

Are you a member of a trade union? Most offer legal protection and services for incidents outside of work?

 

Any legal cover provided by house insurance?

No home insurance etc.

 

Contacted a few no win no fee places today so will get in touch monday they said, just don't want to be stung with ridiculous fees if I did get anything, on the other hand they know what they're doing i suppose.

Plenty of claims companies that give you 100% of the money and claim their fees from the insurer.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Oh I didn't know that,one of them earlier did say they take a 'success fee' then another which is calculated by how much work they've had to do but won't be more than 25% without vat...seemed steep to me but I'll see what the others offer

Do you have house insurance? if so check if it has legal assistance cover included, most policies have it and they will put you in touch with one of their solicitors to handle this for you.

No they don't. You struggle to find a solicitors firm that doesn't ask for a contribution towards your own legal fees of up to 25% these days as it's not commercially viable not to.

 

Since the government changed the rules on 1st April 2013 and decided that ATE insurance premiums and success fees were no longer recoverable from the other side these have unfortunately had to have been taken from the client's damages.

 

There is absolutely nothing "shady" about it, all firms do it now or they would go bust. This is just the new way claims are funded.

do you have any idea which ones don't charge a fee and just claim back off tescos insurance? i contacted irwin mitchell and national accident helpline.

 

no house insurance unfortunately .

The site rules prevent recommending specific law firms to use so you'll just have to have a Google.

 

Unfortunately renegadeimp is wrong and you will struggle to find a law firm that won't deduct the ATE insurance premium and up to 25% of your damages for your own legal costs from your compensation.

 

That's just the way it's done these days. I'm still waiting for my car and home insurance etc premiums to come down as promised, but I won't be holding my breath.

i've managed to find one who doesn't charge me any fees,i get 100% of whatever i get and they claim back from tesco insurers.

 

seems i was lucky finding these local(ish) guys.

 

forms they sent me have been filled out and being posted later so its just a waiting game from now i guess.

I would check the small print very carefully as you may find that the ATE insurance is payable by you as it is not recoverable from the Defendant's Insurer.
