    • Thanks for opening, it's been another rough year for my family and I've procastinated a little.. Due to the age of my defaults on this and other accounts (circa 2021), I really need to avoid a CCJ as that will be another 6 years of credit issues. Mediation failed as I played the 'not enough info to make a decision' however during the call for some reason they did offer settlement at 80%, I refused. this has been allocated to small claims track, court date is June 3 and I've received their WS. I'm starting on my WS and wonder what your advice would be given the documents they have provided?. They do appear to have provided everything required of them (even if docs could be reconstructions). Not really sure what my argument is anymore but I do want to attend court and see this through. Should a judgement be made against me then I will clear the balance within 30 days and have the CCJ removed - this is still possible isn't it? I'm going to be reading up today and tomorrow and hope you can provide me some guidance in the meantime. Thanks as always in advance
    • I have now received my SAR. It includes a great deal of information! Is there a time limit on how long account information is kept and/or can be provided to debtors? I have received many account statements which were not previously sent to me. I remember that the creditor should provide explanations of any acronyms and abbreviations that maybe used in the documents. Is this still the case? Also what, if any, are the regulations in regard to adding fees to a debt? Can fees be added to a debt after the court has approved a charge on a property. Perhaps due to the numerous owners of the debt, many payments I made were not properly recorded on the account, some were entered over a year after the payment was made! Following the Legal Charge, I paid every month until my payments were refused. I am trying to compute the over payments, but the addition of fees etc. is confusing me. Any comments and/or help would be appreciated.

    • They have defended the claim by saying that the job was of unsatisfactory standard and they had to call another carpenter to remedy. My husband has text messages about them losing the keys a second time and also an email. What do they hope to achieve??? Most importantly,  as far as I have seen online, now I need to wait for paperwork from the court, correct?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello, I'm so ashamed and I regret what I did.

I know it was SO wrong I didn't know why I did it!!!!

 

i enter and grab 3 eyelashes of £1each, a total of £3.

 

 

started going around the shop trying to put those things in my bag.

I was totally freak out but I did it.

 

When I was going to go out the store some guys stopped me and asked me to come with them.

Suddenly my heart was in my hand, because I was so nervous.

.. THEY have CAUGHT ME, i'm going straight to jail.

 

they took me to a special room and ask me to take all my belongings out and show which one I had stolen.

I did so, and they say WHY?

So stupid, for £3.. Primark is one of the cheapest shops why you did it?!?

 

 

I was super nervouse I answered I DON'T KNOW! Im so so sorry!

 

The guy: "thats not enought" give me your ID. Where are you from?

 

I say: argentina. (I gave my ARGENTINIAN PASSPORT)

 

They took some photocopy I guess, and a picture of me.

 

They said, YOUR PASSPORT DOESN'T HAVE A VISA..

YOU KNOW THAT YOU NEED A VISA TO COME TO UK, NO?

 

I say: yes, but I have 2 nationalities. I'm also from Spain.

 

He say: ah.

 

they asked me several questions about if I'm a student or work here and where I lived etc.

 

AND, I COULDNT HAVE THE BETTER IDEA TO TELL THEM THAT THE 1st OF FEBRUARY I WILL COME BACK TO ARGENTINA!

 

Then, they ask me for the address from argentina!

 

They have my two address, from UK and ARG.

They verify the address, by asking me to show them an email of a receip,

then to verify the ARGENTINIAN address I had to ask MY MOM VIA WHATSAPP,

and ask her IN ENGLISH, to tell me my address.

 

Then they say:

that because I had more stuff (creams that i've bought in Boots,

they will keep it till I have the ticket to prove that I really bought it. (I didn't have the recipt)

 

they let me free.

With a paper of RLP, "notice of intended civil recovery".

 

I RUN TO BOOTS AND ASK FOR ANOTHER TICKET.

THEY GIVE IT TO ME. AND I RUN TO PRIMARK AGAIN.

AND ASK TO TALK WITH THE SECURITY GUYS.

THEY TOOK MY RECIptS FROM BOOTS,

3 minutes later my stuff was back to me.

 

NOW: my questions are if you can answer them,

 

 

I will be so so grateful and maybe relief I will never ever do that again!

 

I HAVE READ IN CAG THAT THEY SAY NOT TO PAY RLP.

IGNORE THE LETTERS.

THEY ARE JUST SCARING YOU JUST TO MAKE YOU PAY THEM.

NO POLICE INVOLVED SO NO CRIMINAL RECORDS.

 

but: will I have problems to enter my country (argentina) because they have photocopy my argentinian passport..

 

How many letters will I receive?????

 

How much money they will ask more lr less??

 

Is the police going to follow me because of this insident???

 

What if I want to come to the uk again, and want to work, or rent a flat????

 

Remembering the thing that they say YOU DONT HAVE A VISA HERE (in the arg pass),

THEY CAN USE THIS AGAINST ME FOR A CRIMINAL OFFENCE?

That I was "illigal" or sth???

 

 

I have the other passport from spain as well.

 

 

But I don't know!!!

 

PLEASE I HOPE YOU ANSWER, YESTERDAY NIGHT WAS A NIGHTMARE. I COULDNT SLEEP.

 

 

I HAVE THIS THING IN MY MIND AND IS EATING MY BRAIN.

 

IF MY MOTHER NOTICE THAT, she will kill me and be really dissapointed about me. I'M 21 YEARS OLD :(

What has happened is you have run into a bunch of bullies and as you were frightened by them

 

 

they have passed on your details to another bunch of bullies.

 

 

Nothing bad can happen though if you ignore them,

 

 

they are not going to contact you in Argentina or Spain and they have no right to do anything in the UK so relax.

Yes they will. They will only write to the UK address and nothing will happen with Argentina

 

Forget all about it - nothing more will happen. RLP will write but will get no response

Any advice given is done so on the assumption that recipients will also take professional advice where appropriate.

Just to assist you. RLP will only contact you at the UK address you have given. As they cannot say who will open your mail in another country, they would not dare send any letters there as they are bound by the Data Protection Act. They cannot contact any third party without your written express permission unless you were under 18 and living at home with your parents.

 

I would be very interested in what letters you receive from RLP as they may just change the usual format to a different one as yours is quite an unusual case.

 

Of course the standard advice is to ignore them. To make this speculative invoice into a debt, the retailer (Primark) must instigate legal action in the county court and I can say with some surety that they don't bother.

 

On the RLP website, they show cases where they have won. In fact, RLP have never 'won' anything as they didn't take the court action. Since 2012 (when they got utterly beaten) no further cases have been put forward.

 

Most of all, remember to read every letter they send as they can be very misleading. What they say they can do and what they actually can do is nothing short of a gulf between dreams and reality. Don't be fooled

The thing is that, they will send letters to the UK address. And the Arg address later...

 

 

Okey, lets supose they do not send me to the Argentinian address.

 

But, I will be in Argentina, so, the letters will be send to the UK address.

 

 

No one can read this letters, and I am not going to be there to see what they say!!

 

So if they want to go to court, or sth..

 

 

. They will never reach me because I will be in Argentina.

I doubt very much that they will send any letters to Argentina but you seem to be worried about getting letters here.

 

If you are going to be away for a short time then you could set up a keepsafe.

If you are not planning to come back within the next 6-12 months, I suggest writing to RLP to give them your permanent address in Argentina and sent by signed for delivery then they cannot deny receiving the letter. This should stop mail going to your UK address and keeps you in control of your mail.

 

If RLP then chose to write letters to the UK address knowing you were not there, someone may open it which is a breach of the DPA.

If you are asked to deal with any matter via private message, PLEASE report it.

When they asked me to give them my address I give them the 2 address, from UK and Arg.

And I told them im not coming back to UK, so I will be in Argentina.

They told me so, they will send you letters to Argentina.

Bla bla bla!

SO, I WILL WAIT TILL I FIND IF THEY SEND ME LETTERS TO ARG. AND KEEP YOU UPDATED HAHAHA!

Im a bit worried btw, but I shouldnt 😄😁
