Hi,

 

i hope its ok to post this here?

 

and i seem to have 'lost' a thread i was following..

 

and wonder if anyone can help

 

im currently after reclaiming OSC and DLC from brighthouse?

 

i recently received back my paperwork for SAR and dont know what i do next?

 

its quite lengthy, 41 agreements spanning 17 years.

 

. could you point me in the right direction?

i have recieved my SAR paperwork from brighthouse,

 

i am no longer with them as a customer.

 

. but the paperwork is for 41 agreements spanning 17 years..

 

what is my next step for reclaiming OSC and DLC ?

thankyou, do i then send it back to brighthouse? with a cover letter stating reason i want it refunded? being that it was forced upon me (as it was for many) that you have to take the osc and dlc or you cant have the goods?

post your spread up first

work out the avg apr they have charged

or just use the highest you can find [last agreement]

when you say 'post your spread up first' what do you mean?

 

 

that i post here the completed spreadsheet?

 

 

also the interest is already at 5 figures (nice if i did it correctly)

 

 

does this sound right to you, ive only done 3 pages of 114 brighthouse paperwork?

hi again..

well, spent a full day learning all about excel :|

 

hit a problem with it though,

 

 

if i use the highest interest rate (29.9%)

after 4 or 5 pages of paperwork the Compound interest is EMMENCE!

and the excel spread cant work it out

or the totals anything over 100,000 comes up in calculation as ########..

 

 

bearing in mind i have 114 pages to go through..

 

 

so i tried it at 8% simple (which is the rate FOS would use) this seems ok for now?

ive finally finished the OSC part, just got to do one for DLC, should be alot faster as i can now copy and paste dates and agreement numbers from the OSC sheet

 

i also need to put together a cover letter

i tend to think fair is fair.. so wrote ALL payments on the sheet, im not sure this is the right way.. but thought i best put them down and cant then be accused of 'hiding' anything

I have now completed paperwork and have put together a cover letter explaining my reasons for reclaiming OSC and DLC, ... i hope ive worded it correctly and not missed out any points?

 

Dear Sir/Madam

 

I purchased a range of goods from Brighthouse (Stretford Branch) under the above account number, up until 16th November 2013. I made regular weekly payments on these goods, including

Optional Service Cover and Damage Liability Cover, which are listed in the attached documents.

 

I believe that Optional Service Cover was mis-sold for the reason set out below:

 

I was led to believe by your staff, who are very forceful and extremely convincing, that OSC had to be taken otherwise I could not have the items, and that the items would not be covered in the event of breakdown if I did not have OSC.

This is in fact untrue as, according to the Sale of Goods Act 1979.. Goods are protected against breakdown and failure even after the manufacturers guarantee has run out, as goods must last a reasonable time – and this can be anything up to 6 years from the date of purchase.

Therefore goods purchased from you would be covered against breakdown and failure for the whole period which I was paying for them (3 years on most items) and would not need the extra cover forcefully provided to me by you.

 

I have also found that Damage Liability Cover was mis-sold, as I was told when I purchased the goods, that DLC would have to paid on the items, it should of course of been an optional requirement, due to the fact that the items would be covered by my own home contents insurance, at no time did Brighthouse staff advise me of this. I was never given a choice, and was forcefully instructed that if I did not pay the DLC then I could not purchase the goods.

 

If my complaint is upheld I will require a refund of all Optional Service Cover and Damage Liability Cover payments made, plus interest.

I would also like to claim statutory compensation in view of the fact that I have been deprived of the use of this money.

 

Please investigate my complaint within the 8 weeks allowed to you.

thankyou! im not good with words and found it really hard to write.. took me 3 days haha

 

all the template letters on internet are for banks and loans PPI, and not really covering what i wanted..

 

fingers crossed now for a positive outcome :madgrin:

this morning i had a call from my local Brighthouse branch, asking me do i need anything?

ERMM..NO, THANKS.

.she reminded me if i change my mind im welcome in store any time.

. (strange, ive not heard from them since November 2013)

 

Then this afternoon customer relations at head office phoned to say they have my paper work, and what can they help me with?

i said its explained in the cover letter,

she said well yes, but we've pulled your file and it looks like you willingly signed for service cover.

. i told her that as stated in my letter, i was told i had to take it,

she wanted to know did i ever take it up with the manager, i said no,.

. she said if i had spoken to the manager he would of explained to me, that it was optional...

 

at this point i asked that if she needs to know anything else could she please write or email, have i done the right thing?

 

 

i dont like talking on the phone, and i didnt have my paperwork to hand as the grandchildren are here

Yes, indeed you did do the right thing. You have made a proper complaint and they are obliged to respond in writing to you within 8 weeks. Talking to them on the phone can lead to all kinds of problems and they are very likely to say things they wouldn't dream of putting in writing.

 

You might also be pleased to know that this company along with others of their ilk, will now come under Parliamentary scrutiny :)
