Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I am getting nowhere with Barclaycard. I requested copies of my charges issuing them with SAR request. I then got a letter back stating I had a total of £120 in charges. They cashed two cheques for £10 each for the statements but have yet to receive them. They then credited me £120 to my account and ignored my request. This has been going on since August and I have still not received my statements. What should I do. I know I need to complain them to the Information Commissioner but I am unable to get a figure of charges as they are ignoring my letters but they keep leaving messages on my answermachine to contact them which I refuse to do as my account is gone over the agreed credit limit because of all the charges and I dont know what else to do? Please help
I know I need to complain them to the Information Commissioner
looks like you're going to have to do this first to get the information you need to make your claim.
Although I have heard of people estimating their claims and saying they were left with no choice but I wouldn't feel happy doing it that way in case I'd under-estimated. Suppose you could try and over-estimate so that they have to prove it was less?
write to barclaycard re there "none compliance" write to DCO saying the same Write to barclaycard state "that this account is in dispute" (or pay minimum ammount) estimate ammount of charges i.e guess and procced with request for payment, lba, and mcol within the normal time scales If court date arrives and they have not provided statments they will be a little red faced if they have to explaine to judge that this is an unsubstanciated ammount coz we won,t comply with lawful requests and we think we are above the law ..keep copys of any and all coraspondance sent recorded delivery of course..so you can show court that you tried to resolve this before getting to court(they take a very dim view of people who show disreguard for the law)TAKE NOTE BARCLAYCARD are you sure the £120 isn,t all thats owed .they dont seem to have done this with other people i.e refund anything till court date is looming
This is MY oppinion for what it worth
BARCLAYS BANK LBA 23/10/05 £2,626.67MCOL ISSUED 11/11/05

I am getting nowhere with Barclaycard. I requested copies of my charges issuing them with S.A.R - (Subject access request) request. When did you send this? I then got a letter back stating I had a total of £120 in charges. They cashed two cheques for £10 each for the statements but have yet to receive them. They then credited me £120 to my account and ignored my request. This has been going on since August and I have still not received my statements. What should I do. I know I need to complain them to the Information Commissioner Get on and do it then, its a simple form online i believe but I am unable to get a figure of charges as they are ignoring my letters but they keep leaving messages on my answer machine to contact them which I refuse to do as my account is gone over the agreed credit limit because of all the charges and I don't know what else to do? Well burying your head in the sand is a sure fire way to mess up your credit rating and finances. Get a grip and deal with it. If its all charges related write to them telling them the account is in dispute. Please help
Sorry if thats a bit abrupt, but don't ignore the problems they wont go away.
You need to deal with it before it causes you more problems.
