Hi, My mate had a leak from his bathroom through his kitchen ceiling and onto his lounge floor, So the council repaired leak and 'defective parts' and said he could make a claim to renew his flooring to lounge re the daaged caused by the leak. Now he recieved a letter from other dept of council saying bog off, we are not taking responsability because we could not forsee a problem with the plumbing and to make a claim on your own insurance?

 

Surely he has a claim against them, would a letter to the dept that refused claim, suffice in reversing their decision?

What was the cause of the leak?

 

It was from fitting the council had previously installed, Commercial and Corporate services stipulate that...after concluding enquiries into claim, that the council could not have known about the fault and that it is unforseable, therefore they dont accept responsability?

 

So if they are not responsable1 then why did they repair the dammage to the ceiling?

 

They urge him to seek independant legal advice etc.

I think you may find that they repaired the fabric of the premisies as they would have to do that anyway. As for the rest of the damage if it occurred purely because of a "breakdown" and was not malicious then claiming off your own insurance would be the correct thing to do.
