You want to know what is there – but also very importantly you want to know what is not there. For instance, the email that they said they sent you before responding to the SAR – did you see that? Is there any trace of of the phone call that you made to the woman who didn't know anything about SAR's? On what basis was the £50 sent to you? Was it unilateral or did they offer it and you accepted it on some condition? When did they send you this £50 cheque? Have you banked it? Also, I think that we need to start understanding what you have lost here. Have you lost any money – and if so how much? Send the SAR to your bank as advised above

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ok here goes

 

 

I just took over a business from previous supplier ...

 

 

The previous supplier was with Bes..

. Bes told me to send in change of tenancy forms etc lease .

.. Before that i got in contract with opus however two months still no contract transfer to.opus..

 

finally after two months they have given the transfer request to.opus..

 

Because of that 2300 they charged me for two months

omg this company is nuts

 

 

i asked them why did you deley the contract

they said did not get the proper paperwork .

.. Lies i faxed them emailed them and took them two Months.

 

 

.. I was out of contract rates fine but is this fair to exploit small business owners i am soo stressed .

 

 

.. I don't know what to.do..

 

 

. I cant even sleep at night because of this..

 

 

. I have giving up on fast food business..

. I please help me..

 

 

Tried talking to bes

 

 

they said they will take me to court yes sure all hassle you caused me.

 

 

I feel sorry for other people who went with this stupid company

Did you use the amount of electric they say? What were the out of contract rates they charged? I would have thought if you were moving in without a contract they should have been charging deemed rates.

yeh but they deleyed my contract to opus i mean this months opus bill is around 350 gas and electricity FOR BES 2000 just for two months look at the difference even at deemed rate they exploited.

It's difficult to comment in too much detail without knowing the full background to your complaint, but there may have been a delay in releasing your account to Opus if we weren't provided with the information we needed to process a change of tenancy on your account.

To: All BES customers or who are going to sign up with them, please take a moment to read this review about BES.

To make this story short, I bought a business previous owner was with BES, he told me some company signed them up, and they are not good, so it is recommend you change suppliers, I said ok.

 

I signed up with Opus, and thanks to BES they delayed the transfer request because of stupid, documents which I sent them but they seemed to lose them and told me to resend again.

Because they were charging me deemed rates, electricity they billed me over £800 pounds, end of august to October, then they sent me the gas invoice of £1700, that was for two months,

Debit recovery management contacted me and said I own them this much I said recalculate the meter readings as they were incorrect, and so they did and they came up with just £84 pounds, as I already paid them £250, so I owned them only 84. Gas problem solved.

 

The business was not running properly, so I decided to shut down the business and go with another business in the future.

Around November I paid the electricity balance of to BES, they wanted 800 but we settled for 500,

They decided to that I pay 500 and settle, still was too much but I said ok, so the electricity account was settled. But after 4 months they come with saying I own them 361 for electricity what a joke, when the transfer request handed over to opus, I have paid what I own to opus and my account is not now closed, no hassle at all,

But this stupid company 4 months and a letter stating I own them 361 what a joke!!! Even after settling the account they still want money. PLEASE SMALL BUSINESS USERS, DO NOT GO WITH THIS COMPANY they are unethical.

Please business users I request you humbly, do your homework before choosing a supplier, to my knowledge I rate this company the worst gas and Electricity Company whole in the UK.

 

I would really want users to spread this message across to other users who are thinking to join this company. Do not waste your hard earned money, money is not grown on trees, if it did I would not have bothered to write this at all.

I have suffered enough because of this company. The business was not even started properly and I was already getting bills. Especially the worst bills were gas and electric.

 

I went to opus and they dealt my enquiry properly and efficiently and I was in credit, although they have dealt with my account properly unlike BES. I am not saying they are the best company go with them but they dealt with my query in a professional manner.

 

I am only an individual person, but if everyone got together they have the power to shut down any company.

I would like that no any small business users deals with company. My aim is that to shut down this company. I know you probably be thinking he is in LALA land, but I am only one, if everyone gets together then there could be a difference. You can do this by getting the message across to users who are starting up their business or who are currently doing a business. STAY CLEAR OF BES GAS AND ELECTRIC.

YOU WILL SAVE YOUR SELF A LOT OF HASSLE,

 

I thank all the users who took a moment to read this thread, I do not mind if you comment or not, but even after you read this, and go to another thread, I would like to tell you someone else could be suffering in the hands of this company, so you could make a difference by telling your friends family stay well clear of this company.

fkofilee i am glad you know about this company, but spread the message across to anyone who is starting up a business i truly want this company to shut down
