Hi,

 

I have two debts

 

one from a Very account from last year and also

 

one from Argos Card

 

both have now gone to DCA's (Lowell & FRS respectively)

 

now what should my next step be?

 

I have just completed a budget sheet online with my incomings and outgoings

 

should I attach this to the "Ask Creditor to Accept Pro-Rata Payments" template with the recommended payments

from the budget sheet and post this off to the DCA's?

 

it is my intention at the end of the month to send the "Full Subject Access Request"

template letter with fee to both Very & Argos Card Services

as the majority of the debt owed is charges.

If it were me I would send a CCA request to both DCAs....see if they have the correct paperwork.

 

If they have only just been sold on to these people I would do nothing else for the time being.

might be an idea to update each one with what has happened sine may.

It gets them to produce a copy of the agreement they are relying on to collect the money.

 

As they have 12+2 working days to comply it will buy you some time so that you can get the SAR off.

 

Have you got any or all of the statements for each or either of these accounts?

Sorry if this sounds dim but I still don't understand why I would need to see a copy of the agreement? if they don't have it does that mean I should still be dealing with the company?

 

I have a couple of the latest statments but almost none from the last couple of years...

If the DCA can't supply a copy of the agreement (or a reconstructed version) then they do not have the correct paperwork to collect the debt. Without these they cannot enforce and should put the account on hold until they can comply.

 

From what you say, these accounts were running until relatively recently but I'll ask the question anyway....when was the last time you made a payment on either of these accounts?

Oh I see okay that makes sense.

 

The last time I made a payment looking at my noddle credit file was January of this year however my argos card one has disappeared from my credit file by the looksof it...

 

What do your own records say about the last payment. I am guessing that it would not have been six or more years ago but just checking.

Well I posted the CCA Requests off on Saturday so hopefully they will be delivered on Tuesday (I think I missed the last post on Saturday...) I'll begin adjusting the templates for the SAR this afternoon as well and get those sent off close to end of the month when I get paid so that the cheques don't bounce ;)

 

Thanks for your help so far and I will make sure to post the replies I receive with regards to the CCA Requests.

Received a text today from FRS today:

 

"Mr Carl_B, your account has now been defaulted. In order to help you settle your account we may be able to offer you a reduction in your balance. Please call on 08445590303 to discuss this option."

 

Two questions:

  • Having now signed for my CCA request this is actually incorrect? as my account is in dispute until they reply with satisfactory documentation?
  • Is the offer to reduce my debt a hook or is it actually a likley scenario? I believe the current balance is around £130 but this is mostly charges the actual figure was close to £60...

Cheers I assumed as much,

 

 

I answered the phone to them today

(I usually have them all blocked on my phone so it just sends them to voice mail but they change the numbers up occasionally)

 

 

I explained that I would only deal with this in writting and that I would not confirm any personal details as they had phoned me

and I was unsure that they were who they said they were, and about 15 minutes later the text above arrived.

Quick question this 12+2 days

 

 

I am supposed to give these companies for the CCA Requests to be fulfilled are these business days only?

or do you include weekends as well?

 

 

and the +2 I'm assuming I disregard that and just work off when I know the letters arrived?

 

 

I'm setting up a an alert on Google calendar so I know when they should of replied by.
