    • Ok you are in the clear. The PCN does not comply with the Protection of Freedoms Act 2012 Schedule 4 for two reasons. The first is that in Section 9 [2][e]  says the PCN must "state that the creditor does not know both the name of the driver and a current address for service for the driver and invite the keeper— (i)to pay the unpaid parking charges ". It does not say that even though it continues correctly with blurb about the driver. The other fault is that there is no parking period mentioned. Their ANPR cameras do show your arrival and departure times but as that at the very least includes driving from the entrance to the parking space then later leaving the parking space and driving to the exit. It also doesn't allow for finding a parking spot: manoeuvering into it avoiding parking on the lines: possibly having to stop to allow pedestrians/other cars to pass in front of you; returning the trolley after finishing shopping; loading children disabled people in and out of the car, etc etc.  All of that could easily add five, ten or even 15 minutes to your time which the ANPR cameras cannot take into account. So even if it was only two hours free time you could  still have been within the  time since there is a MINIMUM of 15 minutes Grace period when you leave the car park. However as they cannot even manage to get their PCN to comply with the Act you as keeper cannot be pursued. Only the driver is now liable and they do not know who was driving as you have not appealed and perhaps unwittingly given away who was driving. So you do not owe them a penny. No need to appeal. Let them waste their money pursuing you . 
    • If Labour are elected I hope they go after everyone who made huge amounts of money out of this, by loading the company with debt. The sad thing is that some pension schemes, including the universities one, USS, will lose money along with customers.
    • What's the reason for not wanting a smart meter? Personally I'm saving a pile on a tariff only available with one. Today electricity is 17.17p/kWh. If the meter is truly past its certification date the supplier is obliged to replace it. If you refuse to allow this then eventually they'll get warrant and do so by force. Certified life varies between models and generations, some only 10 or 15 years, some older types as long as 40 years or maybe even more. Your meter should have its certified start date marked somewhere so if you doubt the supplier you can look up the certified life and cross check.
    • No I'm not. Even if I was then comments on this forum wouldn't constitute legal advice in the formal sense. Now you've engaged a lawyer directly can I just make couple of final suggestions? Firstly make sure he is fully aware of the facts. And don't mix and match by taking his advice on one aspect while ploughing your own furrow on others.  Let us know how you get on now you have a solicitor acting for you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, I just want to know if I can still claim bank charges for the last 6 years back?

 

I know it was fairly easy few years ago as my brother got them back but

 

can I still claim then now or is it too late?

 

I feel its not fair for a bank to charge me for example £54 for being overdrawn for a few days by few pounds.

 

I would appreciate anyone's advice.

Hi I have exactly the same problem

 

I have been sold the gold packaged account and only used the mobile insurance and

 

when I tried to make a claim I had to pay £25 fee.

 

It was pointless.

 

All the other benefits I never use.

 

I have an overdraft £1300 because of my ex boyfriend.

 

I pay around £30 in charges a month which I would rather use to pay the overdraft and get rid of it.

 

I tried to claim bank charges back for the last 6 years but they refused it today.

 

What can I do?

I have had a gold packaged account since 2009 or 2010.

 

 

It was sold to me by a staff member in the bank.

 

 

They told me how much I will save a year but I only used mobile insurance and made 1 claim but didnt get my phone repaired anyway.

 

I pay around £30 a month for their maintenance fee and because I have an overdraft of £1300.

But obviously I have gone over the overdraft and been charged

 

 

sometimes even over £50 so this was going on for months,

I got charged then they took the charges

which made me go overdrawn again

and got charged again and so on.

 

 

Sometimes they even applied an unpaid item fee of £5 for no reason as I wasnt overdrawn by more than £1300 the month before.

 

 

I sent them a letter saying I want the charges back and got a phone call saying they will not refund me.

 

 

The charges total around £600 in 4 years.

 

 

I am struggling financially which they can see as I have constantly in my overdraft and I cant get out of it.

 

 

I dont want this account anymore.

 

 

I opened a new account somewhere else and I am getting my wage into the new account where I will only pay £2 a month

and I have no overdraft there.

 

 

What can I do?

 

 

I never used their stupid benefits from their gold account and its pointless for me to pay £15 a month their charge

and pay £15 a month interest for using overdraft because I am constantly in it

and I dont want to be.

 

 

And I would like my £600 back because their are thieving ......

 

 

... lol. Any help would be appreciated.

if the benefits of the package were of no use to you

 

you could certainly claim that you were misold the account

 

and reclaim the monthly fee for the package cost plus interest

do a spreadsheet for the package cost, and forward a formal complaint to nat west that you were misold

 

the account, as the benefits were of no use to you

A spreadsheet of detailing the maintenance fee of £15 month

and the interest fees every month for using £1300 overdraft?

 

 

Or just the maintenance fee?

 

 

And showing them how much I paid since 2009

 

 

and that I never used it and therefore was missold?

 

 

And can I claim back the maintenance fee?

 

 

I am sorry I need better explanation I dont want to do it wrong.

if these were post NOV 2009 [bank charges]

 

 

then under hardship/BCOBS you could get them back.

 

 

as for the packaged account fees.

 

 

how were you sold the gold account?

 

 

if you went in for an OD and they sold this to you

I think that it had a fixed FREE OD [£100?]

and other amounts [the £1300] were fee free?

 

 

then why did it cost you £15PCM, whrn a normal OD would have been cheaper?

I was asked to come to the bank for a review I think and

 

 

a guy told me how much I would save a year by having the gold advantage account

like mobile insurance and car breakdown cover and other stuff.

 

 

I never used any of the benefits

 

 

I definitely want to try this.

 

 

The bank charges I want to claim back are from nov 2009.

 

 

But I dont know what to write in the letter.

 

 

Also I guess the calculator will calculate the interest is that right?

the int rate will be the OD rate they charged you on the statements.

Hi, I would like to ask, I just checked my bank statement and it says I got a refund of £24 for charges. Would this mean they somehow accepted they should refund the charges but think that £24 is enough? Or I am not sure why they would give me £24 back? Although I asked for £550. Thanks for advice

your best way forward is to concentrate on getting the formal complaint going for the package fees

Hi,

 

 

if I send a complaint to natwest saying the account was missold and

I was told how much I will save every year when really I am not using any of the benefits then will I be refunded the fees back?

 

 

Because I pay £180 a year for having this account and not using the benefits at all and this has been going on for 5 years.

 

 

I tried to make a claim on that mobile insurance but I had two phones then so the one that was broken wasnt insured and so I couldnt even claim.

 

 

Its just pointless for me having that account.

I am going to get on it this week.

 

 

I just received a letter after 5 years of opening the account asking if I still want to use the account with benefits

and if its not suitable for me anymore to let them know.

 

 

I think they think I will try and claim and thats why they sent it because I havent received this letter before in the last 5 years.

And I still havent received a letter about the rejection of the refund of bank charges.

 

 

I wonder why as they poster it twice now apparently but I get all other letters from natwest
