ok, i have posted in the welcome thread previously, about my discovery of this great site, and my plan to reclaim charges made against me by RBS. i have been reading all the FAQ's, and following many people's claims, especially within the RBS forum. well done to all who have been successful so far!
so far, i have sent in my s.a.r. in mid october, and received my statements last week, very prompt! they charged me £10.
i have been carefully going through my statements, and have totalled charges of £1,524. i've also fed these numbers into the simple spreadsheet that is in the library, but i understand that i shouldn't worry too much about the interest at this stage. i'm a bit confused about this part still.
i have also prepared my prelim letter, which i will direct towards Tommy McLean.
Do you think that this will be the best address for me to send to?

03.11.06 Received letter from Tommy McLean offering full amount of £4451! Hooray!!!!! 26.10.06 received offer of £2685.00 in full and final settlement, sent refusal informing them I have filed my claim. If they do not refund by 3rd Nov I will proceed through the courts 26.10.06 filed claim with courts 16.10.06 received letter back offering £830, sent refusal, have until 25/10 to respond 11.10.06 sent letter requesting full refund within 14 days or court action 10.10.06 received statements, charges come to £4451.76! 26.09.06 sent S.A.R - (Subject Access Request)
Sounds like a good plan. You are right enough about the interest, this is only added when filing a court claim.
Keep it off the spreadsheet for the moment (when I did mine, I "hid" the relevant columns then printed it off - easier to retrieve that way).
Get your letter of to Big Mac and see how quickly you get your "bugger off" letter. (I estimate about 8 days)

hi everyone. well, got my first letter from Tommy Mclean today, it is the standard one saying "we consider our charges to be fair" etc.
i already have my lba almost ready to go. I'm in two minds as to whether i want this to go the court route: on one hand, i'll get to charge them a whacking amount of interest, but i'll have to scrape cash together for the court fees. (how much are they?)
on the other, i'd have a nice lump coming to me for christmas.
i'll worry about it when the next response comes in i suppose......

I wouldnt worry too much. If Tommy (Big Mac) McLean is up to his usual standard, you will get an offer of about half this week/ start of next week and, when you reject, you should be offered the full amount within 4 or 5 days.
My guess is that the money should be in your account on or around 5 December.

well, that's one week exactly since my L.B.A. landed on Tommy's desk, and i've not heard anything. i'm panicking that my letter is going to be one of the ones that gets lost, so does anyone think i should send a reminder email with the L.B.A. attached?
i haven't emailed Tommy McLean yet, so thought i'd better ask if anyone had any results from doing this?

I'm also at lba plus 8 days and no reply although I'm corresponding with branch manager rather than TMcL, so any advice peeps have regarding your last post will be helpful to me also...

Dave. Personally, if it was me, I would give him a call in a couple of days. I have spoken with him and he is friendly enough and it is probably just taking an extra day or 2 to get back to you. Dont be surprised if you see something in the post in the morning or Thursday

I've been side-tracked a little, so I didn't get a chance to deal with this stuff until today.
I have just sent off this email to Tommy McLean, with original L.B.A. attached. I hope it is firm, but polite, I've heard he's a nice man!

I am writing to you to enquire if you have received and read my letter dated 20th November, in which I ask for bank charges to be refunded to me within 14 days. I have attached it here for your reference. I have also attached a chronological schedule of charges against my account.
It is now the 1st December, and I would like to remind you that I must stick to my deadline of 14 days (allowing for delivery), and therefore I will be filing a claim at court on Monday 4th December.
Please be aware that if this matter goes to court, I will be claiming for the full amount, plus interest, which totals £1,986. The amount without interest is £1,524.

We did receive your letter and responded with a letter dated yesterday,
though it may have gone to the post only today, given that our last mail
pick up is at 4.00pm.
Our letter, however, simply reiterates our view that until the OFT completes
its investigation into current account charges, we believe them to be valid.
As a result, it may be best if you to proceed down the legal route within
your own timescales.
I am sorry this is unlikely to be the answer you would have hoped for.
