    Default My capital one claim - some advice sought

    Hi,

    I have so far requested my statements, worked out what I am owed and sent both the inital request for repayment and then following a partial offer the lbaicon to which they responded by saying that they could not improve on their offer.

    I got this letter a couple of weeks or so ago now but due to a shortage of cash I havent yet been able to complete and file a small claims form.

    Do you think it will matter if I dont file this for a while yet or will it look bad in the eyes of the court?

    No, just file your claim. All you have done is given Capital Oneicon more time, although strictly you should not give 14 days notice of court action and then not follow it through.

    You may also be entitled to a fee exemption or remission. Look here http://www.hmcourts-service.gov.uk/H...t_forms_id=168

    iGroup (GE Money) - AoS Filed late, defence late, amended defence also late despite extra time requested and granted.
    Vanquis - Claim issued, no AoS or Defence received

    Hi throwingsevens,
    Capital Oneicon gave me a big fat no at every stage, refusing to repay my charges. As soon as i started the moneyclaim they have settled in full and reduced my outstanding balance by the value of my claim.
    Stick at it, they will give pay up in the end

    It should not be a problem in that there has been a few weeks delay since you last letter. I had the same problem, didn't have the cash to start the moneyclaim for a month after the deadline i gave them.
