    • It you had E7 in the past but have converted to single rate then the meter will still hold the last recorded Night readings. This introduces scope for error when manually reading. If the meter has only ever been used on single rate then there's only one figure that can be taken. For example ours shows "Rate 1" reading and a "Total import" reading, but they both give the sme figure. If it has ever been on E7 the total will be higher, including the retained night reading.

Once it's with the DCAs i do not need to worry as they cannot issue a CCJ only the OCs can Even if i decide to come an arrangement with the DCAs no point as the default will remain for 6 years paid or not paid I should only consider repayment if the OC still won the debt and then issue a CCJ? Just to confirm the default will not be seen after 6 years? No one can tell I had one then after 6 years ill be all good?
    • I'm not sure we were on standard tariffs - I've uploaded as many proofs as I can for the ombudsman - ovo called last night uping the compensation to 100 from 50 pounds for the slip in customer service however they won't acknowledge the the problem them not acknowledging a fault has caused nor are they willing to remedy anything as they won't accept the meter or formula was wrong.   I'd appreciate more details on the economy 7 approach and I'll update the ombudsman with any information you can share. 
    • To re-iterate and highlight my urgent question on this one: The N24 from the court did not include any instructions to submit paperwork 28 days before the date, unlike the N157 received for other smaller claims. Do I have to submit a WS for this court date? Link has!...
    • No, reading the guidance online it says to wait for a letter from the court. Should I wait or submit the directions? BTW, I assume that the directions are a longer version of the particular of claim accompanied by evidence, correct?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am just wondering if anyone has heard of a company called Oyster Bay?

 

 

I have just looked at my Experian credit report for the first time in a while and called them because only my credit card and one other thing which was there twice showed up. The guy on the phone was great and hopefully I should be able to see the full report tomorrow morning but we were talking about the account that appeared twice and he also mentioned another similar account from Oyster bay. He said it was a pay day loan. Now I did have some payday loans back in 2009 but I have never heard of these people and he couldn't find any info on his system about them. The balance is weird as well, he said in 2010 it was £214 which is an odd amount and in 2009 it was £188, he said it looked to him like two different accounts.

 

 

I have googled it and cant find any trace of a company called Oyster Bay or Oysterbay or any other way I can think of to spell it.

Well thats an interesting one, I havent seen them anywhere either. Mind you, Experian normally has the contact details for them so maybe they may show up :)

The guy seemed really surprised that he couldn't find any details for them, he said to look at my file in the morning and see if I could figure it out and to call back on Tuesday as they are closed for the bank holiday on Monday if I couldn't figure anything out. The only thing I can come up with, and I have been racking my brains all day is quick quid, I had serious issues with them years ago but the amounts don't seem quite right and I definitely only had one outstanding account with them. From my googling I did find an American company called oyster bay finance, which is what made me think about quick quid since they are also American, but I couldn't find any info about them buying uk debts.

There are loads of companies with a similar name, but only the American one had anything to do with finance and even that didn't seem to fit because they mostly do finance for boats and motor homes. Experian had no details on them at all but the guy said that once my file refreshes in the morning the contact details may show up, although the fact that he couldn't find them on his system seemed to worry him slightly. I will definitely look again in the morning but I will be asking for it to be removed since I have never heard of them I cant possibly owe them any money, even if they have bought a debt I have received no notice of assignment and if it is the debt I think it is then its statute barred anyway.

Ok this gets weirder, just logged in and went through every account with a fine tooth comb trying my best to remember who the original creditor was. There is no mention of oyster bay or anything similar on my file today, but an account that matches those amounts appears twice with the default date two days apart under motormile finance, now I am pretty sure this is the quick quid one because mmf were one of the three companies who were chasing me for that. It is clearly the same debt twice but I will wait till next month before I do anything about it since it will be stat barred then. Another mmf account appears which there is no doubt in my mind is Wonga, last I heard that was with a company called gothica who have it marked as settled on my Equifax file. As I am one of the customers affected by their dodgy practices anyway and am waiting on my compensation from them I am tempted to leave this one alone for now as well.

 

 

The question is should I call Experian on Tuesday and enquire about these oyster bay people? there is no mention of them on any of my three files as of today.

Ok I called Experian and the woman said she can still see the oyster bay one even though I cant, she said the company is called oyster bay systems and from googling it I have found a contact address and phone number for a weird looking company. The amounts are the exact same as an account that already appears twice and I am now 99% sure its quick quid who are the original creditor, they have refused to help me in the past so now I really don't know what to do. I am guessing I go through the whole process of trying to find out who owns this debt again (I already have a thread about this from years ago when three companies chased me for this debt all claiming to own it). Or will I just wait a few weeks until the stat barred date passes and send them all the stat barred letter? but then how will that fix the fact that three of them appear on my file?

Just an update: Experian have sent the company in question a message however it is they send messages asking these oysterbay people to fix my address as apparently they have the wrong flat number for me which prevents me from being able to see it on my copy of my report. They have also asked them to clarify who the original creditor was but that was weeks ago and I have heard nothing back, I might call them again actually (Experian that is).

Final update: I received a message from Experian regarding something else and called them to discuss it and ask about this oysterbay nonsense. They said that the 30 days have expired for oysterbay to respond to them about what exactly this entry is for and who they are etc so the information is now hidden from my file until such times as they receive a reply, which they might never do. The duplicate MMF entry has also been removed, I am one happy girl!
