      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just reporting in with a massive £4030 in charges in the last 6 years on my parents' Royalties Gold Account! Was shocked!

 

I have sent off Preliminary Request to:

Edinburgh EH12 9JN

 

on the 23rd October and am waiting for their response.

 

I am just wondering what happens if the charges added between now and the potential court proceedinds take me over the £5000 mark? I have noticed on the Vampress spreadsheet that the 8% interest figure is already at £5161.77. Can anyone shed any light on this?

 

I am fight another battle for my olds with LTSB and their business account just waiting for the statements ...

There is no limit to your claim:

 

Q. Is there any limit to the amount that I can claim?

 

A. No. If you keep your claim value under £5000 then the case should stay on the County Court Small Claims Track. This way, if you lose, you shouldn't be liable for costs.

However, there are actually some advantages to claiming above £5000 - this is discussed in greater detail on the forums.

 

 

I suppose what I am asking is if the original amount is less than £5000 but the interest takes you over £5000 will it still be handled in the small claims court? My apologies for lack of clarity :)

Easiest thing to do would be to split the claim in two. Maybe 2000-2003 and 2004-present.

Panic not, the claim value is ex- interest. In other words you will be ok under £5000 in small claims, although your payout may be more.

I am a bit baffled...

 

Just got a letter from Customer Relations Unit, Edinburgh from Tommy McLean which has confused me a bit, is this the fob off letter?

 

It is a bit confusing because it goes on about credit cards...

 

The OFT has restricted its investigation to credit cards and made no attempt to consult with RBS or the industry in relation to other, entirely different products.

 

I guess this must be therefore time for the next stage?

After an absence I have finally managed to get my Parent's LBA sent out to RBS (27th Dec 2006)

 

Can anyone give me (my dad) any help with the court preparation if we end up there? I have bought the small claims pack from here already :)

 

How are the RBS successes going as I have been busy at work so have not had a chance to see how people are getting on?

I got exactly the same letter from the same woman earlier this week.

 

Screw them I say. You've given them ample time. It does look like they're a little snowed under though.

 

Go to MCOL as soon as their time is up. I filed my claim last night.

 

It might, however, be worthwhile looking at Paul Waltons thread. He got his claim thrown out i think.

OMG!!!

 

Just got a letter from RBS this morning saying they are going to put the entire amount £4030 back into my parents' account!

 

I decided to wait for a response rather than get into the court proceedings! My olds are over the moon, it's there 30th Wedding Anniversary this year so some of the cash will go into that pot :smile:

 

Once the money gets into my parents' account I shall give some back to this forum :)

 

Am still very much stunned!
