Good Evening Fellow Caggers...

 

I need some advice on behalf of a friend.

As in the thread subject, Stanford & Green are chasing a council tax debt for £398. This is for the period of 2013 to 2014 (Apr to Mar).

 

The person concerned didn't look at any of her post for a while however They are coming Monday to levy goods and remove them.

 

The person in question vacated the property Jan this year and has a full proof of tenancy.

 

Is there anything that can be done to stop the bailiff attendance?

 

I would like to add, the amount they are claiming is for a 3 month period. Also the council have charged her for 2014 - 2015. Could she theoretically counter this?

If you could provide some more information that could assist. For instance, the person appears to have vacated the property in January and yet the Liability Order appears to cover the period up until March 2014. Has the council been advised of the date of vacating? If so has the LO been adjusted?

 

The council are perfectly correct to charge her for the period of 2014 to 2015 and will do so UNLESS they are advised of the date when the property had been vacated.

 

The debtor does not need to allow the bailiff into her property but if she has a motor vehicle this is almost certainly at risk.

 

The 'starting point' has to be to speak with the local authority and provide some evidence of the date when the property had been vacated. This needs to be done ASAP !!
