Hi all, I have recently been contacted by a debt collection agency on behalf of a well known bank, in relation to our mortgage.

 

 

We have a court order made in 2011 in which the judge suggested that we pay a certain amount towards the arrears. This arrangement has been adhered to up till today.

 

 

My question is do the well known bank have the right to start harassing us about payment - probably trying to force us to pay more?

 

 

What are our rights in such a situation?. I was of the opinion that when a court order is made and it is adhered to, no further action could/should be taken.

 

 

Any advice you could offer would be appreciated. Thanks.

Tell the dca to do one. Court ordered payment overrides everything else. Sadly the dca thinks they are more important.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Why don't you tell us the name of this bank and also the name of the debt collection agency – or are you trying to protect them for some reason or other?

If your payment arrangement is subject to a court order and you are maintaining that, then the bank/DCA has to apply to the court if they want more money from you.

 

I guess you could write them a polite letter advising that you are adhering to the court order and to please back off.

Is the DCA acting on behalf of the bank or has this been sold to them ?

 

It would as BF has said, be more helpful for us to advise if we were to know the name of the bank/DCA :)

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

There is now a DCA allegedly chasing this, the bank may have no reason to contact other than that they may apply to the court for a change of payments and can of course "ask" for a voluntary increase at anytime

Yes, I'm well aware that they could ask for voluntary additional payment - I always advise that a letter is sent stating they are adhering to the court order, they can also advise the court that the claimant is attempting to over ride the order.
