I had a small Halifax Bank Xtraloan in the mid 90's over a period of 24 months.

I still have the original agreement, where they have typed in a 'X' in the Premium Protection Insurance box and not ticked by myself. I also have confirmation of monthly payments statement from them.

My questions are, can I still submit a mis-selling complaint considering how old it is and if so what calculator spreadsheet would I use ?

If compound, what end date would I enter - last paid premium date or current ?

Thank-you

A belated thanks again dx.

It's a Loan so therefore 8% simple stat spreadsheet ? No APR26.9% to be applied ?

First payment 24/11/1995

End Date 30/07/14 ?

I have 12 x £11.34 Insurance Premium = £136.08

Plus 8% Simple Interest = £199.24

Total = £335.32

Does the above sound correct ?

Also shall I attach spreadsheet to complaint or await further for their response ?

Cheers

Cheers again dx.

So use FOS questionnaire and not the Halifax one on their site ? Would they have been regulated in 1995 ?

And finally do I include copy of my agreement and spreadsheet ?

Apologies for all the questions but just need some clarity before I proceed

always use the fos CQ

spready & covering letter

if you have the agreement all the better

same process for any PPI claim.

Hi,

Just to up-date on the situation regarding the miss-sale of PPI on an old XtraLoan.

I collated all information that I had including the original Credit Agreement details and monthly paid premiums statement, and sent a very detailed letter / FOS questionnaire explaining reasons for miss-selling and enclosed the documentation.

I have now today received a response from the Halifax advising that they are now collating information but to help them assess the complaint further, they have sent their own questionnaire to be completed and returned within 14 days.

Considering that I had already sent them documentation details and reasoning etc for ppi complaint, am I obliged to not complete ?

Also as the loan was quite some time ago would I be wasting £10 in respect of a Subject Access Request, as on past experience with other antiquated complaints, information provided has been very little ?

Thanks

that's usual delaying tactics

prob get a few phone calls with loaded questions too

don't answer them.

no I wouldn't fill that in

but refer to the fos one you sent.

Cheers again dx and thought as much.

I will send a reply asking that they refer to FOS questionnaire previously submitted.

What about the SAR, considering loan was taken out in 1995 ?

Thanks

No not this time as I believe I have the majority of paperwork needed and considering how old the account is I believe not much more will be provided.

Do you think that I should still request one in the meantime and advise the Halifax that I am doing so ?

if you've never done one to HBOS

its always worth it

esp the sight of the account/comms log.

many a time their are details in that

the creditor doesn't want you to see

or even knows is their and cements a reclaim

with no get out for them.

I remember one account here

one simple line in the comms log

resulted in the op's claim

going from £3000 to +£15K!!

Ok thanks again dx for your time.

I will get one sent asap once SAR address located.

Shall I contact Halifax to let them know that I am doing this (they had asked for a reply within 14 days), even though I have already submitted PPI complaint ?

OK thanks again dx but in the meantime shall I respond to HBOS advising that I have submitted a SAR ?

Apologies for my daft questions but I usually request SAR before submitting PPI complaint, in order to check that I have everything or enough information. In this instance it was due to the age of the loan and that I already had application, credit agreement and statement details.
