Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Can anybody offer me some advice on the following matter please ?
My son had a cheque cleared from his account, of which he had no knowledge.
Upon contacting his bank (Abbey) to request further information, he was told there would be a £4 fee to reveal to whom the cheque was made payable.
We declined this offer and decided to see if any other family members could help.
All became clear when my Wife produced a till receipt from one of the largest supermarkets in the UK, it appeared that she had picked up her son's cheque book by mistake, went shopping, used one of his cheques, signed in her own name and produced her own guarantee card.
This error on her part was not noticed at the supermarket, but, in my opinion what was much worse, the discrepancies were not picked up by the bank i.e - incorrect signature, incorrect card etc.
What should we do ?
Obviously it was a genuine mistake on my wife's part, and she does not want to be charged with fraud, however what on earth was the bank doing ?
If they could be so lax in processing a cheque that was so obviously wrong, what chance do we have if this was a 'genuine fraudulent transaction' ?
The simple (easy) solution would be to do nothing and refund my son his money, but part of me feels that something should be done.
Query: When you say signature is not checked, do you mean at the shop or the bank ?
Does this mean I could sign one of my own cheques as Mickey Mouse, use another cheque guarantee card, and my bank would still honour it ? I could then dispute the transaction and have the money refunded... great.
We lost £1000 to Farepak so this could be a way of having a merry christmas after all !!
It has been done re Mickey mouse in shops and yes to both, clearly couldn;t have been checked by shop and definitely not by bank. And no you could not dispute it with bank unless you wanted to be accused of fraud which I'm sure you don't want to do or are suggesting.

Not at all, what I have learned today is that people should look after their cheque books as carefully as their credit/debit cards if 'the system' can be beaten this easily.
