    Default Digital Direct....please help??

    Hi, i am having an issue with the online electrical retail store Digital Direct, i wondered if anyone could help me??
    I bought a freeview pvr last month, i checked my postcode and it was confirmed that i could recieve freeview but after recieving my box it didnt work, i couldnt receive any channels so i returned it and was sent a replacement which didnt work either, my connections were correct and my ariel was working so i returned the 2nd box and asked to swap it for a dvd recorder as i am gonna just keep my sky box now. They have said that i can do this but they want to charge me four times the "carriage cost" of returning the previous boxes which is £32 and two times the "No Fault Found Charge" which is £25 each so thats £178!!! the original box only cost £230, an amount which i have paid and nothing to show for it at the moment. Can they do this????

    You must also ensure the goods are "fit for their purpose". This means they should be capable of doing what they're meant for. For example, in the case of a pen it should be able to write. But bear in mind that if a customer has made clear they require the pen for a specific purpose - for instance, calligraphy - and you've confirmed that it will be suitable, then it must be fit for that purpose.
    You required a system which would work at your address, they said it would but it failed. It's not fit for purpose so they must bear any associated costs with putting it right. If they can't you should get a full refund.

    Note that sometimes this isn't the box being faulty, and the fact you can't recieve freeview at your house. Try a nice cheap box off a friend, whos box does work, to be sure.
    Just because it says 'works in your area' information is sometimes wrong.

    I donlt think this would stand up to much scrutiny. Yes, the purchaser would expect it to work as advertised, but radio transmissions are fickle things and there is every possibility an 'accessory' like an existing aerial or the dropwire is filtering out the requred signals (or even an amplifier stripping off some multiplexes). If the dealer can show the item works as advertised anywhere else, the shortcoming is not with the device, so a SOGAicon rejection could not apply. (This also holds true for mobile phoneicon coverage, but most networks are prepared to cancel a contract within 14 days if coverage is not suitible) - but as the mobile networks also control the coverage, there's a correleation there.

    I would be more inclined to get the dealer on your side. Were you advised at any time there would be these re-stocking charges BEFORE they were made known to you? If not, I'd challenge that - and perhaps get an aerial installer to check out your aerial feed. Who knows, your problem might have been caused by the satellite dish guy bending your aerial out of the way in the first place!
