    • If a DCA supplies a reconstituted copy of the CCA what would be the next step. It seems that a reconstituted copy must be a " true copy " of the executed agreement, it must contain the Prescribed Terms. But given that there is no copy of the applicants signature surely it could be an agreement form with the details filled in. How can it be assumed that this " copy " represents a true copy that the claimant has supposed to have signed. Cabot have demonstrated a bit of sabre rattling when they say "Until we're able to provide this information , your account is unenforceable. This means we're not permitted to obtain a County Court judgement against you . Whilst we cannot pursue legal action, your balance remains outstanding ". I looked up a case... Cabot UK Ltd  v  Bachellier (2010) which might help, but it's tough reading, I'd prefer to plough through War and Peace. This particular case with Cabot is not huge , approx' £140, but the only other worry that I have is also with Cabot...£2100. They may try to make a point with lesser case.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I want to get my house in order so need some advice on what to do.

 

Back in late 2007/early 2008 I got an unsecured loan of £2000 from Welcome.

 

At the time it was set out at 25 payments of £199

 

I made payments for a while until I was out of work paying what I could and when.

 

in late 2008 they renegotiated my loan and setup a new one.

 

These are the details of what they said 61 payments @ £ 85 current Balance £ 3,771

 

I got a settled mark on my credit file and another loan was setup

now showing several months with a 6 mths late mark on each of these ,

 

this left me with a bitter taste in my mouth and was stupid to set this up,

to cut a long story short I haven't paid a thing because I felt as though i was ripped off,

 

I want to start paying it off but feel that it was underhand what they did at the time.

 

I believe I was sold various PPI's etc which may have esculated the total loan.

 

What should be my first step, I have no paperwork as I buried my head in the sand.

Hi,

 

I had a loan with welcome finance back in 2008 and defaulted in May 2010.

 

Several months ago I noticed the default record had disappeared probably due to the 6+ markers everywhere which I think was wrong. Don't know why the record entry was removed.

 

I have logged in today and there is a new entry saying MKDP LLC default May 2010 for the same amount,

no history or anything just a simple (8) marker.

 

I know its probably a long shot but is there anything I can do?

Sorry but no, Welcome Finance have sold the debt to MKDP, Welcome Finance have removed their Credit Reference File listing and this has been replaced and updated by MKDP which is correct and a true reflection of the account.

 

You will soon hear from MKDP notifying you of a change of debt ownership via a Notice of Assignment.

 

Because this is a Welcome Loan, have you claimed back any charges or PPI?

 

Is this loan secured or unsecured?

I would suggest PPI/Charges over the two accounts will prob wipe most this debt.

 

get that SAR off.

NO, only a Postal Order or a Cheque - a tenner note will disappear!

 

And also do I send it registered?

 

Yes by registered post, print off a copy from the Royal Mail website when delivered so you have a full track and trace facility in place.

 

Also what do I do if I dont know my account number?

 

Modify the SAR template letter to suit & also by adding in your previous address if applicable so Welcome Finance can then easily trace you on their systems

I would just like to let you know that I received 2 letters today,

 

1 from Welcome saying the debt had been sold and

 

1 from MKDP saying to "phone them they can help to come to an arrangement"

 

Both in the same envelope I might add.

 

I was kind of expecting a court summons before hearing anything from MKDP but it was not the case.

 

I will be posting the SAR and CCA to the respective companies in the morning

That is a normal procedure, MKDP will have printed both of these letters.

 

You need to keep an eye on your Credit File, MKDP have a nasty habit of changing the default date to the debt purchase date on your Credit File.

Welcome Finance should have closed their Credit File entry with a zero balance and a settled marker, MKDP will open up a new entry with their name as the owner, the default date must not change from the Welcome Finance default date so if this has happened then a complaint is in order first to MKDP to update the entry to the correct default date, if not then escalate to the ICO.

If Welcome Finance needs any-more information regarding your SAR including previous address history, Welcome Finance will write to you.

 

Just keep an eye on the Royal Mail Track & Trace (Now called "Signed For").

Ok I received a letter today from MKRR saying I have ignored them and they will keep hounding me with letters and phonecalls until I get in touch.

 

As said previously I have sent a CCA request to them and they signed for it on the 27th May. The new letter is dated the 30th May.

 

Any advice?

 

 

Ignore all contact until the CCA request 12 + 2 working days has expired or they respond earlier, then it will be easier to decide what to do next.

I just sent the letter to small print at the bottom of the page which said MKDP, however the letter came from MKRR, Does this Matter?
