    • Thanks very much Bank. I have topped and tailed my LOC and printed off a copy which I shall post tomorrow by First Class post at my local post office and also obtain a proof of postage. I'll also email them a copy. I've opened a MoneyClaim account, and shall now begin work on my draft Particulars of Claim which I shall post here for your thoughts. And I shan't be using the Moderation service.
    • Yes, it struck me this morning that I'd got it wrong    - no involvement of UKPPO in any previous Tesco thread    - there would have been an entrance sign to a Tesco car park    - CCTV isn't something associated with Tesco car parks. Presumably whoever runs the car park has put CCTV at the electric, and probably BB, areas, done absolutely nothing to stop abuse, and then rubs their hands in glee every time the CCTV catches a motorist out. You can pay £60 and this will go away. Or you can defy UKPPO and rely on their non-respect of POFA, consideration period, etc., should they be daft enough to do court later down the line.  We would support you all the way.

    • If you visited Qatar you could be detained at the border, if the debt has been notified.  If you are only in transit and do not seek to cross border into Qatar you might be ok, but you may want to seek formal advice about this.
    • Howdy, I had a short lived credit card with Vanquis that I did not need. I paid it off in full and called them and closed it with the person at the other end. 2 months later they started sending me messages about late payments, I called them and to find out that the card had not been closed in error and 6 weeks after it should have been closed they paid a google debit of £560. I hit the roof and made a formal complaint that took them well over a month to respond to. They agreed they were at fault, refunded all late payments fees and offered me £100 in compensation. However they said the debit amount stood as 'I had benefit from it' and I should get a refund from google. I hit the roof again but they have stuck to their guns. The debit from google is a genuine one but I wanted to dispute it with google so closed the card so they would have to engage with me. But surely that's neither here nor there surely? What is the next step? Ombudsman takes forever doesn't it?  thanks in advance

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello,

 

2 months ago I was caught for theft in an local drug store,

 

it was very out of character for me and I feel absolutely terrible about it,

and have been feeling awful ever since,

 

I cannot condone my actions and I will never so such a stupid action again.

 

The police were called and the matter was resolved by community resolution.

 

I have googled online and I haven't found much about this,

 

I just wondered how badly this could affect any future plans?

E.g travelling, jobs etc.

 

I am not looking to go into a job involving money handling or working with children/elderly/vulnerable adults.

 

Since then I have received 3 RLP letters, and

 

although I have read copious amounts of advice on the website,

 

I would like someone to talk to who could aid me personally,

 

I am student and cannot really afford this debt (I know I shouldn't have done the act in the first place),

 

and just wondered what will be RLP's next course of action?

 

The letters have been going to my home address and my parents are becoming more and more worried.

 

How many more letters/what kind of letters will I be getting next?

 

I'm currently in my last year of university and this is beginning to affect my studies,

 

I don't want my degree to suffer for this either :(.

 

Will the RLP issue go on any kind of record?

 

If I pay will that make matters worse for me (not including the loss in money)?

An anomaly in my case in regards to others I have seen is that my amount is £147.50 rather than the £137.50 which I'm pretty sure it's supposed to be, anyone have any idea what that is about? Also I wasn't provided with a break down of the "costs" to the store, and I think that is supposed to be given?

Stop worrying. Jackie cannot do anything apart from threaten you.

 

If you receive a letter from this silly woman, send the one line reply and use any further letters as toilet paper.

There are many threads on here from people with serious debt issues and serious legal action but this isnt one of them, RLP are just a minor annoyance, like a fly, just ignore.

 

This is a forum so we cant aid personally, if you want advice like that you can visit CAB although they are rather busy these days.

It doesnt matter how much money the claim is for it is still a figure plucked out of the air as there is no debt. RLP cannot affect your career in any way, they have no power to alter your credit record, provide information to any third party and paying them may just encourage them to try and claim that you still owe something long after the event.

The matter has been dealt with in an appropriate way by the authorities and the store has accepted this via the community resolution. RLP wont accept this because ithey make their living trying to scare people.

Is it possible for your parents to be given the info to come and visit CAG for themselves. They will soon see just how much power RLP actually have.

 

If you were to visit the RLP website, they show there how many court cases they have won but:

 

1 RLP have no right to take anyone to court. That onus is on the retailer.

 

2 The last recorded case where RPL 'won' (no they didn't-the retailer did) was July 2012. If they were so sure of themselves, there would be more cases.

 

RLP threaten a data base of offenders which they state that potential employers could look at. The problem with that is that RLP cannot disclose any information to employers without your permission and even if they incorporated that into the forms at the shops, this can be rescinded at a later date.

 

They can also place nothing on your credit file.

 

Towards the end of the process, RLP will send their NON ENFORCEABLE invoice to a pet DCA (debt collector) who work on a no win-no fee basis. When those letters arrive, treat them with the same contempt they treat you with.

The 14 day limit on my 3rd letter has just finished, so I'm sure I'll be receiving more soon.

 

I will keep this forum updated.

 

Once the DCA gets involved, what usually happens then?

 

I just feel sorry for my parents who have to keep forwarding me these horrible letters!

Personally id send the one line letter. Ithers would ignore.

I would send a one - liner as it shows to them that you are taking no rubbish from them. Once that is done, no further correspondence will be entered into.

 

No doubt Jackie will send the letter saying that you shouldn't take advice from internet forums but again, that is bluff and bluster.

Youll get the same as everyone else does. Theyll just ignore you, send half a dozen more letters full of absolute rubbish, then try and pass it on to a DCA who cannot do anything. This company relies purely on threats and intimidation to get what they want. Money. They have no right to harass you and you certainly should never give in to them, simply because you want them to go away. Just ignore everything they send and theyll give up.

I went to my local CAB and asked for their advice, they drafted me a letter to send them basically stating that they have no right to be sending me these demands and that the CAB will back me up in court if it was to proceed, since then RLP sent me a letter basically ignoring the whole thing and continuing to say the same things as before. It was nice to get piece of mind from the CAB, however it doesn't seem to have done much, thus I'm just going to ignore them from now on!

I would actually have sent a letter back if they ignored a letter from cab. Something along the lines of you will now be taking legal advice for harassment as well as other reasons. Make jackie sit up and take notice.

 

However knowing jackie it would kick her npd into overdrive and youd probably get more letters.

It also shows that RLP have a single script and can't deviate from it. Presumably they had no answer!

 

If they can't respond to a valid point with something other than their next letter then even they aren't pretending that it's any more than an income generation scheme. Perhaps their chief advisor was out of office?
