eve0317 vs Barclayscard (microfiche problem stage)
I have 2 barclayscard account and I just sent my SAR for both account and they replied within 14 days (wow), problem:
One card they provided details from May 2004 only
One car they provided details from Oct 2005 only
reasons quoted are really the standard microfiche not readily accessible blah blah blah
Now: I have 2 ways to resolve problem
a) send them a reply to say they did not comply with my request and noted Abbey case for microfiche, and see what they say
b) wait until 40 days pass and sent them to IM
I will try a) and see what is the answer to that.

Hi eve0317,
I've issued a claim against B/card based on an estimate. If they want to disagree they will have to provide the figures so one way or another we'll get there in the end. Anyone sending a SAR to b/card should include a paragraph about the Information Commissioner's finding that the Abbey's microfiche system is, in fact, a relevant filing system, so it must also apply to b/card.

Hi, i am at the same stage with Bcard using the microfiche argument but can find no quote or link to the new ruling re Abbey that i can quote to Bcard. can anyone help - I believe there are many folks in this same position, thanks in anticipation

I raised the microfiche issue with one of the DP Managers in BC along with my other instances of where BC have breached the DPA in dealing with me.
To quote them 'In respect of the point you have raised in relation to the microfiche statements, the IC is aware of the stance that Barclaycard take regarding the fact that we do not include statements prior to May 2004 as part of a SAR. The reason for this is because of the way they are stored, in order of billing date, month and year and therefore, do not fall under the definition of a relevant filing system as defined in the data protection act 1998. As we have previously stated, this is not something that Barclaycard has recently put in place to be obstructive, it is a process that we have followed for some time and is there by reference to the act. I have noted your comments regarding Abbey National.'
sorry for not posting, as expected it took me a while to struggle whether to pursuewith microfiche or just put an estimated claim. In the end, I put an estimated claim and just got my reply.
How dare barclayscard decided to pay back only 96pounds, instead of the 244 I asked for (that's exclude interest), well, I guess another letter will be on the way very soon.
