Just wanted to start a thread for my Barclaycard progress. I sent the Subject access request on the 19th October and they have already replied to me with 18 months worth of statements, giving the microfiche excuse.
I have to wait until Monday now to send my response via recorded delivery but it should be worth it. With the 18 months, I have already clocked up £160 of charges, so that should at least double! They have another 30 days to comply.
I received their standard microfiche reply and sent a response to that. Late last week I got a reply to that letter - they are sticking by their microfiche argument, asking me to send £3 for each statement that I want.
What do I do now? Do I wait until the 40 days are up in 2 weeks time or should I send the preliminary now as they have basically said that they will not comply? I was hoping to get some money before Christmas but that is looking extremely unlikely.
I can understand why people lose their nerve and give up, the paperwork seems neverending! Need some encouragement!
Just an update. Barclaycard's 40 days are up now and I will be sending the lba via recorded post today. Wish me luck
There was an article in the metro today about claiming back bank charges turning into an all out war! Banks have had to pay out millions apparently, I had no idea it was that much. All thanks to CAG! ;-)
I sent my lba to Barclaycard after not receiving my full statements. Now that the BC microfiche system has officially been declared a relevant filing system, do I write back and ask for my statements again or still claim based on an estimate?
I received a letter dated 11 Dec from BC saying that since the IC has changed their stance they will send me ALL my statements within 28 days.
This is quite interesting though as my letter asking for my statements in light of the new IC stance on microfiche was sent on 15 Dec.
Most efficient, I must say.
Funny thing is I seem to have misplaced the first set of statements. I must have put them somewhere 'safe' and forgotten where....or Carl Nuttal has snuck into my room and nicked them!!

Nothing would surprise me with Barclaycard. I have had the same letter but worte to them giving them 7 days to get them to me. I have also phoned them and now they have put in an urgent request for the statements, with the xmas post and all that hopefully will get them soon poss prior to New Year.
OK, I still can't find my first set of statements - it is soooooooo weird!!
Do you think I could call up Barclaycard and ask for them again, it's not like I can say they never arrived after the whole microfiche debacle!!
I really want to start my claim with BC and not being able to find the first set of statements is driving me mad. I turned my entire room upside down.
I was burgled recently, perhaps I could use that as an excuse....?
You may need to do another SAR. However I would try and say firsat that they didn't arrive, unless you have informed them in some way that they had but were missing them. You cant do much without them, so I would prob start again. Perhaps they were knicked?
I doubt they were stolen as I couldn't find them before the burglary anyway. I put them somewhere safe and then obviously forgot where that safe place was! If I don't find them by this weekend, I'll send another SAR.
Wow, this thread seems to be almost a year old...I only got around to sending my prelim letter recently!!
I received a letter from BC, offering the difference between the charges and the £12 limit - WHICH THEY CALCULATED INCORRECTLY!! Before I even had a chance to breathe, they credited it to my barclaycard account that has been closed for months.
I called them up to complain and they credited my bank account with this money. Over the phone I said "I do not accept this as Full and final settlement and I will pursue for the remaining charges" and all the agent said to me was "The money will be in your account in 4 days"
Have I messed up my chances of claiming the full amount by having them transfer it to my bank account?
