    Well i thought I would add my pennies worth I had bank charges last month for two lots of £25 so £50 and i received a statement today and guess what yet more charges are being added it all started of with me going overdrawn by £3.87my charge was £34 so i am now £37.87 OD I then got an unauthorised overdrafticon charge of £25 then another for £25 which makes my new total £88.13 OD this is from the 22 - 28th of sept I then paid in £420 and I received a statement today with yet more OD charges added for another £50 because the other OD were up until the 11 sept and the new ones are from the 12th so in total for going OD by 3.87 they have charged me £137.87 I cannot believe they can get away with this ? on top of this after speaking to customer service I was told if I wanted a copy of my statements it would cost wait for it £5 per statement madness Mike

    Hi Mike.
    You have come to the right place!!
    You need to start your own thread so we can follow your progress, this is kickingkay's thread. If you have a good read through the FAQ's, you will find it easier.
    Here you will also find out the bank has to give you all your data for a maximum £10 fee, the template for this letter is in the templates libraryicon along with the other letters to help you on your way.
    If you ask a Mod (the ones with their names in green) they will merge your threads into one so start a new threadicon then ask them to merge this note with it.
    Any problems/questions, post in your thread and someone will answer it for you as best they can.
    Its really bad the way the bank has taken all that money off you for the measly amount you were overdrawn. But you can now start fighting back..... They will try and put you off each step of the way but that is where this site helps you out.

    i think its safe to say we have all had those £25*2 charges and its still not clear to me how they manage to add and justify the extra charge, even if we already know any of these charges is wrong, they have never made ti clear to me?.


    regarding anyone receaving benefits (child/income/etc) its already been mentioned regarding the (inalienable)right to tell them this money is for essentials etc and i will be withdrawing it at such and such a date.

    upto yesturday , it was thought by many that the english banks could take these state benefits at their will as no english law was present to forbid them from taking them, and all that existed was some Banking Codeicon they ignore anyway, wereas the scottish law expressly stops them taking any payment from any state benefits.

    well yesturday i was pointed to this Bank taking your Benefit? Quote this - - MoneySavingExpert.com Forums thread, and in there, are links to the so called blue books, and this part Social Security Administration Act 1992 (c. 5)

    "Certain benefit to be inalienable.

    187.—(1) Subject to the provisions of this Act, every assignment of or charge on—
    • (a) benefit as defined in section 122 of the Contributions and Benefits Act;
    • (b) any income-related benefit; or
    • (c) child benefit,
    and every agreement to assign or charge such benefit shall be void; and, on the bankruptcy of a beneficiary, such benefit shall not pass to any trustee or other person acting on behalf of his creditors.

    (2) In the application of subsection (1) above to Scotland—
    • (a) the reference to assignment of benefit shall be read as a reference to assignation, "assign" being construed accordingly;
    • (b) the reference to a beneficiary's bankruptcy shall be read as a reference to the sequestration of his estate or the appointment on his estate of a judicial factor under section 41 of the [1980 c. 46.] Solicitors (Scotland) Act 1980.
    (3) In calculating for the purposes of section 5 of the [1869 c. 62.] Debtors Act 1869 or section 4 of the [1882 c. 42.] Civil Imprisonment (Scotland) Act 1882 the means of any beneficiary, no account shall be taken of any increase of disablement benefit in respect of a child or of industrial death benefit.

    now these books are statute for the whole UK so is this vast book/law? to our advantage and can some of the law people here explain and use these acts to stop the banks etc dead in their tracks with a simple letter?.

    its also werth noteing that theres a thread on here i bumped(i cant give you the direct link as my browser (advanced browser) lost all its open 64 pages and reset its bookmarks today ARRRR)
    that mentions getting an injunction against A&L to stop them closing your accounts for being difficult and asking for your money........
