I am trying to help my son, who is currently a new recruit in training with his regiment. He has managed to accumulate £110.17 of charges as a result of a defaulted mobile phonedirect debit. He has not paid this money, so is not trying to reclaim it, just to stop the debt collectors claiming it on behalf of A&L, and as it is almost impossible for him to do anything its up to me...his mum to help.
I just wondered how to proceed in this case as it seems different from everyboy else...(they have closed his account, but I had already made him change to a different bank as some years ago A&L charged me a huge amount for being 10p overdrawn, and when i went into my local branch to speak to someone about it the manager came out of her office, said she would waive it in this instance and gave me a right royal dressing down about managing my money better in future in front of a queue of customers in the main part of the bank...their mortgage advisor also giggled when she told me there was NO WAY I'd be able to get a mortgage to on my income....not true!!)...and I also would like to know if I can claim any charges back from tmobile...they've charged him twenty odd quid as well...at this rate he'll soon be working for nothing!!
I don't really see that this is any different to any of the charges that other people are claiming. He needs to claim the charges back and then he can pay off the debt collectors with the refund. Even if you do this for him though, he will need to sign the letters himself, and he should tell the debt collectors that he is disputing the charges.
When the Liberals and Conservatives were in opposition they both agreed that banks should pay back high bank charges to customers. Nothing seems to of happened since they came into power as a coalition. PPI insurance has been sorted now they should turn their attention to bank charges and help customers get exorbitant charges refunded.

He doesn't need to have physically paid the charges to claim them back, they will just be credited to pay off the debt on his account, then he only has to make up any diffenece between the debt and the charges, if there is any.
As Caro says, the debt collectors cannot act on an accont in dispute so send off a prelim letter then write to the straight away and inform them of the dispute.
I know I'd be lost without mine and all she's done to help me keep financially straight over the years.
May I suggest you write the letters, then send them to him to sign?
I'd also suggest you send him a stamped addressed envelope back to you, then you know it's been done!
Slightly more expense involved, and a bit more of a kerfuffle, but at least you know it's been done and he hasn't forgotten (or claimed he can't find the time because he's shining his boots!) to post the things.

Well I know its been ages since I was last on....son is now a fully fledged soldier coz he passed his initial training (hurrah) and Alliance and Leicester sent a second letter this morning basically saying NO again (boo)..so it looks like I'm going to have to take it to the small claims court....to have money repaid that I don't actually want repaid.....just don't want Alliance and Leicesters debt collectors to have it!!
Am fair bobbing myself I admit...have never done anything like this....I'm a library assistant for goodness sake......would appreciate any words of support or pointers as to wording to the courts with my strange case (sounds like the story of my life!!)
