My partner has 4 bank items with Lloyd's (lloyds tsb) 2 loans, 1 credit card and an over draft, today he received letters that the loans and credit card, all rights and entitlement and interest has been given to 1st credit, but nothing about overdraft.

 

We have been chasing Lloyd's for some time as they always refuse it change partners name and also refused to take payment for the accounts, we are unsure what to so as no money has been received on all account to Lloyd's. Since December 2008, and defaulted then too, but if 1st credit take it a new date on default would be inplace :(

The date of default should not change and if it does you can complain

I think that Lloyds banking have just sold a ranch of debt to 1st Credit, my old OD with Halifax has just gone to them as well.

 

So you haven't paid anything towards these accounts since 2008?

When were they defaulted and do you still have the DN's?

When were they opened?

 

I would be inclined to wait until 1st Credit contact you and then send off 3 CCA requests

Ok

So first thing is to let 1st Credit know that you will only communicate in writing via royal mail. There are a couple of letters in the library that I would edit and combine to suit your needs

 

Do you have evidence that these accounts were on your credit file prior to jan2013 showing a default?

 

Why do you think that two should have been written off?

 

Are the DN's compliant, ? If you are not sure post them up minus personal details

 

I would still get those CCA requests off asap

Ok finally heard from lowell stating that Lloyd's have passed the debt to them and all future communication and payments must be made to them, I'm now doing the CCA, I have proof that they were all defaulted in 2009 in January, but bank overdraft is 70 without charges but with charges it is now 194, and that defaulted in June 2008.

 

I've told my partner not to do anything unless by writing

ok so partner got a letter of lloyds saying that the credit card (£841.47) and both loans (£5617.65 and £2770.00) were sold to 1st Credit on 18.11.2013. i have our bank statement out and the last payment on the credit card was December 2008, and the loans were February 2009.

 

No response has been made from 1st credit, just letter saying that the amount is owed and to set up a payment plan if can not afford to pay total amount, 1st credit Defaulted the account in December 2013, but this is wrong and I've provided proof to the credit agencies but they just say no it is true as we have contacted 1st credit whom informed them of this!!

On your credit file can you actually check that is says default date and not updated or anything else. Also are there any other defaults for the same debts in either the open or closed accounts section

You are going no where with this until you establish when the accounts were actually defaulted.

A SAR to Lloyds to get the data on all the accounts is the way forward.

Be sure to state you require the information on default dates.

I would be very unusual for these accounts to sold if they had not been defaulted.

Does the CRA entry show.

i shall SAR tomorrow, is it £10 per account or just name,

 

just logged onto equifax and it says settled for all llyods accounts, I'm going to print that off to save, but then under them it has 1st credit

Start date is the date all accounts were opened, so cc - 23/06/2008 loan - 4/4/2007 (biggest loan) loan 2 - 27/11/2008

default date 17/12/2013 on all accounts

date updated is 05/03/2014

£10 gets you all the data on all the accounts you have with the creditor.

Shows settled because the accounts have been sold, SAR should still go to Lloyds as the debt purchaser will have minimal data.

Yes the original default date cannot be changed by anyone, one debt one default, one default date.

Ok so I sent the CCA. letters to 1stcredit no response to them, but a letter for all the accounts today saying to make payment or they are left with no option other than to consider county court court. Lloyd's have made clear they sold the debt to 1st credit and show settled on credit file, then 1st credit have opened up on credit file saying default in 2010 for all account

When was the CCA request sent?

It is probable that as usual one part of 1st Crud has no idea that you have mad the request an the standard threatogram has been automatically sent.

 

 

As for the defaults dates were they all different before 1st acquired the debt?

Got a reply today to say, we are aware that you have requested a copy of your original credit agreement. We will contact the original creditor in order to request a copy of your agreement. We will suspend collections activity on this account whilst the matter is under investigation.
