    Default Merchant agrees to take item back.....

    I purchased a pony at the end of August, not happy with it within the week, went back to merchant many times and was ignored. Then involved credit card company. CC co got merchant to agree to take pony back on 10th Oct but the morning it was due to go back the merchant phoned me and said don't bother. Back to CC co who spoke to them again on Monday, agreed again to take it back today Thursday. I contacted them and they finally replied last night to say can't do today, maybe next week and now can't collect you must deliver. This messing about it causing me great inconvenience and I need the pony gone, not to mention the fact I'm paying for it's keep and it's now been 2 months......Any advice???? I'd like to just take it back and leave it there.....

    im sorry i cant help, but prob a few questions
    why did the cc company got involved.
    is there any reason why you want to return the pony

    had it been arranged at point of sale that it can be returned

    Long story but in essence I bought pony for novice child relying on info given by trader. Pony completely unsuitable so wrote several letters that were ignored. Credit card co got involved cos I wrote to them under section 75 of consumer credit act. CC co got merchant to agree to take pony back (in writing) but they then changed mind, CC co spoke to them again and they agreed again to take pony back today, but last night said they are away till Monday or Tuesday so still no definate date...........I allege breech of sales of goods act they deny.

    if they do not take the pony back, or stall everything.
    then i personally would take the seller to court to pay for the upkeep of the pony during that period

    Yeah, after all, if they delayed and it cost you money in the meantime, you should recover those expenses, they caused you to be out of pocket because of their stalling.
