    Question will this make a difference to my claim?

    i am about to send my first letter asking for a summary of bank charges for the last 6 yearsicon to my bank (Halifax). however, my account with them is a student current account. i am not a student anymore though. i have an arranged overdrafticon of £2000 interest free, but if they find out i am not a student will they not charge me or sue me for the interest on this overdraft? i am not sure if their normal current account overdrafts are interest free.

    also, if they only offer me a partial settlement as a goodwill gestureicon, can i request that they write off my overdraft instead? i would be afraid of them defeding in court, knowing my luck with banks (hence all the charges - £100 in the last month alone!!!) they will defend in court!

    any advice is appreciated

    Hi littlewriter,
    I cant see it makes any difference they may well change the rates they use and maybe get you to change the type of account but you probably owe them sum money so what good would it do to sue you.
    As for settlement you could ask them to credit to your account after you win and, finally dont be afreid if they have added penalties to your account its unlawful and against common and statute law its your money and you will get plenty of help here.
    Just read the FAQs and read as many threads relating to your particular bank you should feel a little nervous but not afriad ,read the threads you will find hundreds of ppl were in a similar situation to yourself but they have won, and you can too.

    Not sure i would agree with AL.

    I presume when you got the OD you were a student and have failed to tell them subsequently that you were no longer a student.

    I think youre on dodgy ground and should it come out i think you may be liable for costs and probalby more.

    Look at it this way, if you walked into the bank and gave them false details to obtain money what do you think the courts would call it?

    I would tread very carefully before entering a claim into court.
