Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I started out this process of reclaiming charges using the 'which.com' templates and have sent the letter which states I will proceed to the small claims court if they do not refund within 7 days. This date has now passed and I have discovered your site with different and seemingly better templates. I have not sent a schedule of charges to the Halifax just the total amount. How do I proceed now? Should I send the lba from this site with schedule of charges and then proceed to MCOL? This would delay the process a little and make it look like I don't know what i'm doing. Does it matter that I have not followed the procedure to the letter?
I'm afraid I began the process of reclaiming Halifax charges using the templates from the 'which.com' website. I have since discovered this site and it seems I need to send a schedule of charges which I have not done. I have informed the Halifax that I will proceed to MCOL if no response in 7 days. This date has now passed. Shopuld I send the lba from this site with schedule of charges before proceeding to MCOL?
i would just to be safe.. they need to know how much you are claiming, or have you already supplied that figure?? If so, just carry on with the next step...
answered on your other thread..try and keep just one thread going.. No, as long as you have sent the letters in order and followed the basic procedure. I only sent the full list yesterday with my N1 claim to the court.. hope this helps
I sent them a total figure only with no mention of interest. I guess there's no harm in back tracking and sending another lba. It makes me look as if I don't know what i'm doing (which I don't) but they are still in the wrong and I'm due my money back!

Thank you. Deleted the other thread. New to those as well! Should I say very confused! I'll send the MCOL with schedule of charges and copy it to the Halifax. Thanks again.
good luck Sharon.. if you need any help just ask, or go onto the Real Time Chat at the top of the page and the guys on there will always answer a question
Send your lba along with you list of charges, dont put any interest on this.
make sure you list your charges as they appear on your statements along with the date you were charged. (this will let them see you know what you are doing) give them 14 days to reply, if you dont get a reply, start you court/mcol claim
The interest only goes on when you do your claim for court or mcol.
If you need any more help, you can put it here on your thread or pm me.
Good Luck with Your Claim

If I have been of any help, please click the Scales of 'Justice' in the botton left corner. Thanks
I am just composing my lba. My charges add up to 2854.00. Interest charged on my account is 101.77, is this the figure I include as overdraft interest charged? Seems a silly question but I thought maybe i had to calculate something.
Thanks Olliebear for merging threads. Yesterday was a steep learning curve for me but think I got there. Sent the schedule of charges to the Halifax (not the 8% interest). Did not include interest charged on overdraft as was minimal and too long winded to list each item (some as little as £0.08.) Also completed MCOL so now I need to sit tight and wait 3 weeks. Fingers crossed ;-)
I'm not too computer literate and am having difficulty finding my wat around the site. can anyone tell me how I can find the second bank template letter. This is the one that informs the bank I intend taking action through the small claima court if they don't pay back my money within 14 days. So far they have ingnored my first letter which was sent on the 1st March

The first thing you need to do is to get a thread. There is a button at the top and bottom of the page saying new thread. Click on there and and name it. That now is your own thread. Keep updating it and you will get all your questions answered.
Please forgive my tardiness in replying to your very helpful letter supplying me with your knowledge of accessing the template letters. I've only just returned to my computer; which indicates why I was experiencing difficulties. I simply don't use my computer often enough. it was most kind of you to take the time and trouble to reply and i look forward to staying at your guest house some day.
Regards,
J. Paul.
PS - Good luck with you bank challenge, assuming that is why you are on this site.
