Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I got the standard Microfiche guff, I called them and received a call in return (they were moving offices and were having major problems - I attempted to give them another!)
I quoted the case against Abbey and they said there were differences.
Abbey stored the data on Microfiche in Person order.
Barclaycard stored their data in billing date order, this was the difference, it wasn't readily accessible therefore didn't fall under the DPA SAR.
He said they had had a visit from the Info Comm. and they seemed happy with Barclaycards filing system to date.
I said to put a note on my file that when the Information Commissioner did rule this argument as baloney, could they send me my statement copies by the next post please?
He said he would but I'm not holding my breath.

I wouldn't hold my breath either, but you should have a read of the recent posts on abbeys system because its relevant to Barclaycard.
Basically the ICO has suggested it will be amending its position with regards to manual filing systems and whether they are relevant.
Barclaycard are in for a shock i expect.
Actually i don't think they're in for a shock they know whats coming but it will be good for us.
