    Default Nat West Bank Statements ** WON **

    I today received bank statements back to 2002 after sending DPA letter. They have not cashed my £10 cheque yet which was written from another bank account!! Second letter will be on way today to try & claim £1059 for my son.

    The compliment slip has an address 225 Shenley Road, Borehamwood, should I send the second letter there??

    Unhappy Re: Nat West repy in 3 days!! £1087 claim

    had a reply from Nat West today, only 3 days really impressed by speed but not the response!!

    They believe their charges are fair and applied in accordance with our agreement and published tariff. They state they are satisfied all complies with all applicable laws & regulations.

    Letter was from Stuart Higley, Customer Relations, Nat West, 225 shenley Road Borehamwood, WD6 1TE

    They are basically fobbing us off. Should I now start legal proceedings or try another letter.

    Please advise someone, really skint so want to be sure before I pay for the small claims court.

    has anyone beaten Natwesticon yet, cannot seem to see if anyone has actually got money back from them.

    Default Been told by Nat West £1059 would not be refunded

    Sorry to start another thread, but not very pc literate & could not work out how to add to my previous comments.

    I have written 2 letters now to Nat West on behalf of my son asking for refund of £1059 charges. Have received replies very quickly. They inform him that individual refunds paid to customers were based on a commercial decision and made individualy.

    He has been told that he will not receive a refund and that to serve papers they should be sent to the registered office: 135 Bishops Gate London EC2M 3UR.

    I cannot find anyone in the forum who has received big refunds back.

    Should I continue to go all the way and now contact the small claims court?

    Well, that depends. Do you want your money back? Because they're obviously not going to give it back unless you sue them!

    Thanks Alan, sorry if I sound thick but I need to get things straight in my head before I do things. I have spent hours reading this site and am a bit better finding my way round.

    I have found the guide to completing the Moneyclaim form, thanks, but I cannot quite understand.

    Do I have to list each individual charge or just claim for 1 sum with the to and from dates.

    As it will cost me £120.00 do not want to do it wrong! Once again sorry to sound so thick!!! x

    You don't need to list the individual charges in moneyclaim - just give a total and the period that the total relates to.

    You will then need to include the statement regarding section 69 interesticon. Put in the amount of interest as at todays date (or the date you submit the claim) - then you need to calculate the daily amount (total charges @ 8% divided by 365).

    As I was unsure how to complete form, thought I would try a last ditch letter to Sir Fred Goodwin, the Group Chief Executive in Glasow. Sent letter last friday )28th April, sent copies of letters sent & replies received (fobbing off replies basically11)

    I said I would give him until Monday 8th May I would then proceed with legal route.

    Received a letter this morning-
    Dear Mr Walsh (am dealing with this for my son)

    Thank you for your letter dted 28/4/06 addressed to Sir Fred Goodwin, our Group Chief Executive. In view of you comments, we have asked for a full briefing from those involved. Once this is received , a formal response will be sent to you from the bank's executive.

    We will aim to get a response out to you as soon as we can but we also want to make sure that a thorough investigation takes place. If, for any reason, there looks like being a delay, we will, of course write to you again to explain why.

    If you do have any queries in the meantime, please feel free to contact us.

    I have received a reply from Sir Fred Godwin as follows:-

    Thank you for your letter of 28th April. I have noted your comments regarding the efforts you are making to bring your finances into order and your feeling that Naw West is not helping by continuing to apply charges.

    From the copy correspondence you enclosed, I am aware that Mr Higley, from Natwesticon's C R U, has confirmed the bank's stance on the applicatin of charges to a customer's account. I am sorry if you do not agree that they are fair and reasonable.

    You have suggested that customers are being refunded because banks recongnise the charges as unfair. As Mr Higley stated in his letter, each case is looked at on an individual basis. If the bank has made an error then a refund would be justified ohterwise the charges would stand. On reviewing the operation of your ac****, it is cleear that there have been regular excesses of the £500 agreed limit. In fact, between Nov 05 & Feb 06 no credits were received into the account & during this period the overdrafticon was never lower than £644 & reaching a high of £872. On this basis there is no justificatin for a refund, hence the letters you received from Mr Higley.

    However, I am conscious that since you have started paying credits back into the account the only times that you exceeded the limit were when the monthly charges were applied at the end of March & April. I am also aware that you converted the account to Adv Gold in Aug 05, which is costing you £10 per month. I am not sure if you are using the benefits sufficiently to justify this fee and you may want to consider converting the account back to Current Plus.

    In an effort to help you bring your finances back onto an even keel, I am prepared to refund March & April's unauthorised borrowing fiees totalling £56 and cancel the £28 fee due at the end of May. If this is acceptable to you then please sign & return the enclosed copy of this letter and the necessary arrangements will be made.

    Thank you for taking the time to write to me. I hope the action I have proposed will enable the banking relationship to move forward on a more postive basis.

    To go back to a Current Plus account I would surely have to clear the overdraft, which I am unable to do. The reason I got into this state was that I was laid off work & the bank kept adding charges!!

    I would have to borrow the £120 court fees, do you think I stand a chance of winning??

    I'll tell you what I have already said a few times, it's a case of odds:

    Possibilities for winning: 1) Bank pays up at 1st letter, 2) bank pays up at 2nd letter, 3) bank pays up at claim issuing stage, 4) before acknowledgement of service, 5) after acknowldegement of service, 6) before lodging a defense, 7) after lodging a defemse, 8) at allocation questionnaireicon time, 9) after allocation questionnaire, but before hearing, 10) any time between hearing date set and actual hearing, 11) on court steps. Or 12) bank goes in hearing, gets trounced.

    Possibilities for losing: 1) bank goes in hearing, you lose. Er, that's it. What do you lose? Your court fees, and you never get money back to which you had kissed goodbye a long, long time ago anyway.

    Just to bolster your resolve, have a look at the survey. Then draw your own conclusions. We can't GUARANTEE you'll win, but these are damn good odds.

    On that strength have lodged mcol to Nat West for my son Tuesday 6th June. Thought I had better get in before the rush!!

    Claim for £1230.93
    what a surprise, have received 'notice that acknowledgment of service has been filed'

    Cobbetts have 28 days to file a defenceicon. If it does go to court am I allowed to represent my son as he is petrified? should I just sit & wait now? Spent hours reading FAQ's but get confused a bit.

    He will come with me but does not really understand what I am doing for him.

    Hopefully it will not come to this, but better to be prepared. If it does go to court will be looking for a buddy!!!!!

    As no-one answered my last query I have purchased the book about small claims as advised.

    I need to be genned up if this goes to court!! Just hope I will be able to represent my son as he is now sh*****g himself poor love!!

    In one way I hope it does go to court, have enjoyed reading other members experiences making the banks squirm. I personally have a case with the Abbeyicon, have not received anything back from the court yet.

    Feeling very nervous but excited at the same time, should all be ending soon.
