hello again to you all, had to reset up account as comp crashed and lost all data so have been here before hence, hello again. advice on this would be gratefully recieved, followed everything as advised by you lovely people so far, first letter went and i got a nice reply which arrived on the 14th day asking me to give them 10 days to investigate. got my next letter ready to post, but unfortunately i accrued 2 months arrears on my mortgage, may and june this year, this is mainly because of their charges. been unable to pay them back so far but was told had till 6th Dec to do so. tried to come to agreement with them in sept but they wouldnt accept anything less than £285pm which would be a struggle but wanted to pay them off. sods law when payment was due my wages didnt arrive due to problems in payroll, first thing i did was phone the bank and explain they said they would let all payments go out of my account but didnt take the extra money for the arrears, they contacted me and said i had to pay it back by 6th Dec.
Was speaking to them again on the same day the reply came back from my initial letter asking for all charges back,i was trying to come to an arrangement again they said 'you have till 6th Dec or you can pay us £425 for the next 4 months end of, oh and by the way weve just defaulted all your RBS accounts while weve been talking to you you will recieve notice tomorrow this will give you 28 days to pay your arrears'. sure enough yesterday i recieved a default notice saying i had 28 days to find £2525 to pay off my overdraft and 7 days to pay back my mortgage which is £139000. if i didnt make a suitable arrangement then they would register it as a debt and start procedings to recover it.
I still want to send my 2nd letter as i had noticed another referral charge and a £35 charge they added to my morgage in june which i was going to add on however with this latest sneaky punch from them im not sure how to procede.
Please advise
if its a mortgage and its current, claiming when mortgage is current, could cause problems as the mortgage company wont take to kindly and could cause you grief if you fall into arrears
