Thought id start with the LOWEST and EASIEST one first, but appears this may be the Hardest.
Not to worry......
My unfair charges were for £120. plus interest of a few quid.
Sent 1st letter - response was "actually our charges are fair"...we'll close your account..policy stuff ...blah blah.
Sent 2nd letter - response was same as above but also "OFT agreed not to touch us"...blah blah..."we'll refund £4.00 per charge to reduce amount you paid in fines from £20 to £16"....thats a refund of £24.....shall i?...shall i?...nah!
my balance is at zero...so i think i'll put in a line about how i have lost faith with them so would be happy if the account was closed...and charges returned of course.
gotta say...EGG send their letters out quick. just 2 days response time...this is the only thing Ill thank them for.
Ill always remember the conversation I had with a member of the EGG team when I asked her not to charge me a fine that would be incurred in the future when I was clearing my balance today!!!.........she said "erm....bare with me a second"...and clearly went to ask someone if they were willing to...."im afraid we cant" was the reply.....(so they could have then..... I thought to myself).."ok" i said....."i'll log on to the CAG then...." put phone down.
SO, ANYWAY. last letter dated 16th OCTOBER so they have clearly given me just enough time for 14 days to be up and get a response in.
.........interesting to see over the next week how others will get on..good luck all.
I will go to the next stage in just over a week. definitley going to court if it goes that far. how great would it be to set the precident for everyone else!!!
ok about to start the court process....and i will turn up.
first i must accept their offer of £24 in view to them sending me the rest i am claiming and also to point out a few things.
interestingly, if Egg have offered me £24 to reduce the fines i paid from £20 to £16 (6 defaults) then i will ask for them to prove the costs when it was £20 and ask the question ....were you over charging me before? how do i know you are not overcharging me NOW!!.....they really must prove their costs NOW as UNDERSTANDABLY I am suspicious.
plus (more importantly) surely if their costs were a true reflection and they have now reduced them from £20 to £16 .... then they would be making a loss!!!!
i will ask them to show what they have done to save money to pay for this reduction. to prove the £20 was a fair charge in the first place.
which we all know is not true.
interestingly also...... if EGG are only charging TRUE COSTS
then why are they listening to the OFT at all.
IF it costs £20 to them per default, then thats what you are gonna charge...because thats what it really costs.
It would be FAIR to charge actual cost regardless of what it was.
....you would just need to prove it if questioned.
anyway....onwards and upwards!!!
