      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well not had a single letter or reply from this bunch of clowns, that was until today

as they have sent the following email to my works email address not sure how they found out my works email address.

Please also bear in mind that as that email was sent to your work email address this will now more that likely be stored on the companies servers/database and could possible be retrived by the company doing a simple routine company IT check.

Well still getting emails to my works email address, i have deleted all the emails from my out look, just a complete pain and stressful as i do not want my employer to find out, can o bock the emails !!!!!!!

Motormouth went quiet for a while, but it now seems like a phoenix resurrected. I had nothing for over a year then two weeks ago a spam email trying desperately for me to get in contact. It is Statute Barred now. I do hope they do not start being naughty with peoples credit files like they did before.

If they change default dates on credit files this can be proved by SARing them, and finding out when the last payment on a debt was made - technically a default should be registered up to 6 months after the event (correct me if I am wrong on this)...

Have a quiet word with your IT department and ask them to set up a filter on the server to bounce all emails from MMF.

I would print them off before deleting and send one to MMF, asking for the email to be removed. Give them 14 days to do this otherwise you will take them to court for harassment.

 

I have to agree, keep a copy of these emails , if poss forward them to a personal email account.

Follow that up with a formal complaint to MMF. I included a line about the email address not being secure and private and must not be used

8 weeks later if not resolved go to the FOS and ask for compensation.

 

I went down the formal complaint route with MMF and have not heard from them for a long while now . I actually hit them with complaints to the CSA (credit services association) , FOS, and ICO

I am sure you have done all this already , not heard from MMF since June last year , in fact if memory serves me correctly they agreed with the FOS to close the account

Well they are not giving up, just found this email in my spam folder. Think its just a fishing email so won`t be calling the clowns

have a look at the FCA register for MMF and the conditions placed upon them . This has to be in large part down to the complaints

I complained to the Fos and OFT (once) FCA (once) about the way these people were operating , during my last complaint in 2014 they actually changed their homepage and then had the cheek to pretend that they had always been compliant

But they did not go far enough

 

The misery they caused unjust should have resulted in termination of their consumer credit licence

 

That explains why my motormouth defaults vanished in April

It will also be one hell of a dent to their profit margins as we know that some of the PDL's that they deal with add huge penalty charges . Some of these £100 loans get inflated to over £1000, MMF buy them at whatever % and now all of a sudden they can only reclaim £175. My heart bleeds

It would be rather nice if this sanction (if you can call it that) is applied to ALL portfolios that are purchased....would throw up a load of lemons if 'due dilligence' was applied to the entire loan book.

 

12. Motormile agrees it will not purchase any regulated loan portfolios until a skilled person has signed off that such portfolios have undergone an appropriate and effective due diligence exercise.

I wonder if MMF will stay the course, I know they have been around a while but it can't be good for them . I do have doubts if they actually know what loans they do own or are they just experts in double speak as last year , during a complaint I had with the Fos regarding a PDL they kindly agreed to write off a loan that had been returned to the OC. Mind you I haven't heard from any of my PDL's in well over a year .

I have been writing since they started the threats, they have added 2 defaults for the same debt and according to the credit ref they cannot change the information and send i have to contact MMF. To date i have had no replies since complaining and in fact the only letter to date is from MMF.
