I am, but very hopeful to stay within the fast track, it is the court fees that tipped it over the 15k. I have seen a list of requests you have suggested to put to the court to remain within in a certain track, could you post thsose for me.

An update CHL's solicitors have acknowledged, and have asked for an extention of 28 days to file their defence. The reason they give is that CHL would like to meet with me to see whether this issue can be resolved amicably. The say it would be preferable fo matters to be settled without the need for either party to incur the costs of or dedicate time to continued court proceedings.
Sounds as if they know they are running scared and want to pay me off quietly!! Well lets hope so. Any advice as to my next move and what not say should I agree to the meeting?:o
I'm not too sure of the legalities of it all but I can't really see how a meeting would hurt. Maybe agree to the meeting but strees that you will only settle for the full amount owing.

Only my personal view, but if I was going to meet them, I would want proper legal representation with me to ensure I wasnt intimidated or accidently agree to something I'd rather not have agreed to.
Cant see why anything they have to say cannot be put in writing and sent to you, that way both parties will have an undisputible record of what negotiations have taken place should the case end up in court etc.
All advice is offered in good faith based on my own research and understanding of the laws involved, however I'm not a lawyer!
Please dont rely on annoymous advice posted on a public forum without checking it out for yourself first!
exactly-this was attempted with me by the Northern Bank,but I wrote to them stipulating very exacting conditions for the meeting.....it never happened.I was being set up for an ambush,but they didn't get away with it
Certainly stipulate conditions for example,
the meeting is recorded on audio (and also written if possible) and a copy retained by both parties.
If you are not taking a legal rep then no legally qualified person to be present representing Citi.
Perhaps use of a mediation or abritration service to conduct meeting?

Many thanks all for your advice I will ponder on it over the weekend, and consider bringing along a legal representative. Dolly i live in Windsor, but the meeting will be in Fleet (Hants). I will post my thoughts later.
