    Default Filing with Moneyclaim

    Hi,

    Just entering the details in the Moneyclaim site but I'm a bit unclear on a number of things.

    Is the amount I'm claiming including the interesticon? The org charges add up to £900 but with interest they total over £1,000. This means the court charges rise from £80 to £120 - so do I pay the latter even though the org changes were under the £1000?

    The other thing is the address for the bank - should I just use the Birmingham Customer Care address or their reg address?

    Not sure about the fee's but with regards to the address, have you already corresponded with them at all? If so use I would use the address you used then, although I shouldn't imagine it would really matter as I'm sure anything with a Court Stamp on it would get to where it needs to go in the end anyway :twisted:

    You will have to pay the fees for the full amount - don't worry though - you'll get it back from Lloydsicon when they a) default or b) give in.

    The claim form will work out the fees automatically. I think that it is on the interesticon as well. just make sure that you enter the totals correctly - amount plus interest until date of claim.
    Make sure that you have your daily calculation correct as well.

    Address it to the Branch. the rules are that the case will be alocated to the court in which the Defendant resides or carries on business. You want to have a nice convenient court to go to so address the claim to the branch.

    Actually, in the FAQ's at moneyclaim.gov.uk it states that if it is a corperation that you are claiming against the court hearing would be allocated to the nearest to the claimant (if the claimant is not a business).

    It also states that this may be reconsidered if the defendent claims he/she cannot attend a particular court due to financial constraints.
