Hi there, i was recently the victim of chip and pin fraud with the Halifax.
They refuse to reinburse me pointing out to a clause in my agreement stating that I was negligent with my pin number because I kept it at home in a drawer. May I point out that I live at home and no other person has any access to my house.
I am now going through small claims on the basis that the consumer credit acts clearly states that if it was used as a credit token then the maximum that i am liable for is £50.00 if i was not the person in possession of the card. The act takes presidence over the Banking Code and any clause in there agreement.
Do I stand any chance and if not is there other ways that I can play this
