    Default Waveydave v NatWest ** WON **

    Thought i would add my details here as im sure ill be back with questions soon enough

    I have all my statements from the start of the account so i havent bothered contacting Natwesticon with the SARicon letter.

    Im claiming for £444 over two years


    Initial preliminary letter requesting refund of charges sent 16/10/06 to :

    John Cunnane
    Manager
    Customer Relations Unit - Depot Code 040
    225 Shenley Road, Borehamwood, WD6 1TE

    Sent by registered post so now the count down begins. I'm nervous and excited at the same time but after a weekend of researching and discussing with my Wife we have both agreed that should push come to shove we will stand up in court and be counted

    BY 'eck - Got a very quick reply from Natwesticon, Standard reply as well id imagine.

    Just a few excerpts from it that are mildly amusing.

    " In your letter you have claimed we have been acting as you fiduciary, yet i am unsure of the basis for your contention. This does not form tpart of the normal Banker / customer relationship"

    "I suspect that this is unlikely to be the answer you might have hoped to recieve but nonetheless thank you for taking the time and trouble to contact us"

    Anyway Ill get on with printing the next letter out and getting ready to send but what i would like to know is do i send the next letter NOW (bearing in mind i had a reply from Natwest in 3 days) or shall i leave it untill the 14 days is up ?

    Just in the process of sorting out my lbaicon and obviously the standard fist line of

    " I am very disappointed that you have failed to respond to my letter of the [XXDATEXX]."

    doesnt fit as they have made contact to deny.

    So - will this suffice as a starting line ?

    "Thank you for your letter of 19 October 2006, the contents of which I acknowledge but disagree with."
    and then straight into the rest of the letter.

    Just want to make sure im not opening myself up to anything by acknowledging and disagreeing

    One final thing - in my original bog off letter it states :

    " Should you decide to go ahead, please ensure that any proceedings are served on or registered office address"

    So - do i send my lbaicon to the registered address or to good old Mr Higley ( who the bog off was from)?

    Personally, I would reply to the address it came from. Having said that, I don't think it makes too much difference, as it will get forwarded on if it's wrong.

    Well you are taking action against Natwesticon PLC so it does not really matter. I would send it recorded delivery as a matter of course. Don't forget your schedule of charges.

    I'd give them them 14 days. I am in the same position as you and got the same letter it seems. I got a very quick reply and my 14 days is up today so I will be sending the second letter tomorrow.

    Well Natwesticon have replied to my lbaicon and the reply is as follows:

    "Dear Mr XXXX

    Thank you for your letter dated 31st October 2006.

    I regret that there is little that i can add constructivly to my last letter and note your proposed course of action. I have alerted our lawyers and litigation department accordingly. May i please remind you thatthe address to use when initiating legal documents is that of our registered office, below.

    Thank you for letting me know of your intentions.

    Yours sincerely

    Stuart Higley"
    I assume this is standard but anyone notice anything new or different on there and i would also imagine the line about lerting solictors etc is mearly a scare tactic in teh hope i think sod it - WHICH I WONT

    I shall now give them the full 14 days before i start with MCOL

    Not really.

    They've given you the green light to issue your claim in the courts so just get on with it.

    Use the templates for filling in your N1 or MCOL and get in there.

    Advice given is either my experience or my opinion and is given without liability. If in doubt, consult a qualified professional.

    i think parachute accounticon refers to opening a seperate ( non natweat) account so that you have something to fall back on if they get nasty and put restrictions on your account.

    Its something ive looked into but not sorted yet

    payment by xmas would be loverly although to be fair i think ill use any money i do get from this to pay off other debts rather than fritter on xmas as ive done most my chrissy shopping lol.

    Wooooo - well i finally got round to puting the claim through mcol on the 30th march 07 and Natwet have sent me a cheque today for the full amount + costs + 8% interesticon which totals £538.01

    With the cheque i recieved a letter which states

    "we believe that your particulars of claim disclose no reasonable grounds or cause of actio against the bank. However we believe that given the aMOUNT of your alleged claim it is not commercially viable or cost effective to defend this claim"
    So is that a standard reply ?

    I also got the speel about payment being made in Full and finalicon settlement and that payment is made with no admission of liability and subject to my agreement not to court publicity or disclose details to third parties etc,

    It also asks me to write to the court to discontinue proceedings and not to take any steps to enter judgement against the bank.

    So three things

    1) What do i do next ?
    2) where do i support this site with a donationicon
    3) MODS - add me to the WON totals
