Your advice has not been wasted, and I've contacted the various oc 's with Sar requests. You should have seen what I got back from Abbey!

It's just that caring for my mother and her Alzheimer's has been somewhat traumatic and I've had to both focus on that, and hold down a job. Not easy, I can tell you.

 

What I have established, is that each of the oc's has adequately confirmed that I do indeed owe them money, and how much, and that moorcroft certainly do not have authority to deal with Tye account from abbey that they claimed.

I'm now, once again, in the process of doing the same with capquest.

They say they are 'managing' the account. Not good enough for me, so I've told them I'm not prying them, but will continue to pay the oc.

Abbey came back with loads the last time. I couldn't believe how much paper it generated. It must have been over an inch thick!

 

I thought my noddle credit report would show the owners of each of the debts though.

 

I'm afraid my computer is dying too. I just get a whining and a black screen at the mo!

 

I don't want my fiancée finding out about too much though. Her daughter is in serious debt trouble and she's fallen out with her over it. I don't want her tarring me with the same brush. When asked, I've told her that I'm 'managing my finances'!

Thank you for the info. I use wisecare etc at the mo, and I'm not worried about her getting into the pc.

 

I'm more concerned about the amount of mail it'll generate.

 

I've got some ppi to claim back from Halifax & NatWest I think, and I've covered my tracks with that so far.

That and the amount of time she'll notice I'm on the pc for. Letters out & in etc.

 

I really don't want to queer this pitch. We are planning to get married next year!

and settling by F&F wont stop it all either.

if you'd done that when first advised

I know.

 

It's just that I had masses on my plate with my mother and her care, and holding down a job at the same time. It all seemed to get away from me!

 

I was on antidepressants for a while too!

 

So, to be clear.

I sent out the cca letters and got adequate responses back from several.

Are you suggesting that I do it all over again? To every one of my creditors?

I think I'll have to establish a local po box for the responses. Shouldn't need it long though!

I'm afraid I've had to move twice since I got them back & they got put out in the rubbish rather than them be discovered.

 

I'll set up a PO box here and send them out again though it'll take a few days!

 

Do you not think that given that I'm not employed & nearing retirement, if I offered them say 10%, they'd take it as f&f?

 

If the worst came to the worst, I could live with them just getting £1pcm though.

 

Moving home while on antidepressants wasn't fun, I can tell you!

typically an F&F to an OC is not a good idea and you'd get little discount

however, you'd need to get ALL the statements vi an sar first before even considering an F&D to the OC

if/if not they hold an enforceable agreement is a deciding factor as well.

 

 

if the debt is now owned by a DCA, then all bets are off as to what discount you can get.

bottom line though is the defaulted date of each debt

 

 

regardless to whatever you do, they will vanish from your file on the defaults 6th birthday

, but that doesn't mean the debt is not possibly owed.

 

 

F&F also resets the SB date, and can give rise to the OC selling the remainder on, negating the F&F anyway.

I've been paying them all at £5pcm, so I guess that means I've acknowledged them, at least to the OCs.

I'm guessing that they'll all pass, which means I'm back to square 1. We'll see what occurs over the next 3 weeks!

 

Surely a full and final settlement of the debt is just that. A settlement. Thereafter there being no debt.

keep going round in circles

you need to keep the issues separate

if you've been paying

that has no bearing upon if they hold enforceable paperwork!

no paperwork= no pay.

 

 

and as I've said time and again

an F&F is NOT full and final

the debt will be marked as Partial settlement not SETTLED.

 

 

thus the remainder exists and CAN AND DOES get sold on years down the line

always best to demand total removal of the debt form your file if you want to settled

and then when they say no, you'll realise why...

I have received a letter from crapquest that says they are now 'managing' one of my 5 accounts.

 

I am back now & will send them an SAR today.

 

I believe that they then have 40 days to respond.

 

I will scan in what I get back and take it from there.

 

All of these accounts defaulted in 2009, post a rather messy, (and expensive), divorce.

It's the Sainsbury's Bank one. It went default in 2009.

 

I'll send a CCA request asap. I didn't send the SAR although I printed it and put it in a SAE.

you cant CCA a bank account

so sar to sainsburys is the only thing you can do to get anything and that would be statements.

 

 

its probably all charges anyway

which is why they sold it to a fleecing DCA.

Ok.

 

I've been paying Sainsburys Bank £5pcm for years.

Now Crapquest have said I have to pay them as they are managing the account now as it's been transferred to them from Arrow Global.

 

Sticking just with the Sainsburys Bank one, an unsecured loan, what do I do now?

A, continue paying the £5pcm into Sainsburys, or

B, stop the payment to Sainsburys and start one to crapquest, or

C, stop paying altogether.

 

I'd be interested to know what would happen in each case though, although I guess that if I do nothing, nothing will change.

I don't think I said it was a bank account. At least I'm sure I didn't.

 

It was a personal loan through Sainsbury's Bank.

I normally take it when people use the word account it means bank account

so its a loan

so yes CCA request Capquest then sorry

and if arrows have it

its been sold on

No probs.

 

I'll send the cca, but what will happen if I stop paying Sainsbury's.

their letter says that all the payments I have made to date have been sent to them.

 

 

That would indicate that they, Arrow with capquest managing it on their behalf, own the loan & therefore they may have legitimate reason to say I should be paying them.

 

Is it possible that they have lost the paper trail & would therefore fail a cca?

 

If they do & I stop payments as a result, is the loan unenforceable?
