Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Need to pick a legal brain on this. A relative has a suspended possession order on a secured loan. He's had trouble keeping up the payments and they have issued a warrant for eviction.
I've just been looking at the paperwork and I've noticed that the original claim form has one claim number but the possession order uses a completely different claim number, which doesn't appear anywhere before then. The eviction warrant uses the number on the order.
Does this give us any legal opportunity to go back to the court and challenge the order? Just need to buy some time really, since the eviction is set for three weeks time and we can't organise everything to sort them out before then.
No. There is one claim number on all the pre-hearing paperwork, then a completely different one on the order. The second one is the one quoted on the warrant.
