    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

i just thought I'd share this.

Every sunday morning I get up at 5am (horrid I know) but I do so for a good reason! What I do is plan a week of easy meals, not easy to cook, but easy to reheat the following week.

I've found that cooking a load of 1 pot meals like chicken casseroles, Bolognese, hotpots, curries and alike a tthe ungodly hours saves me a fortune in electric.

After cooking the lot I store em all up in a bunch of tupperware containers and get one out as and when I need it. The costs I've saved cooking this that early (eco 7 hours), is amazing. At least £1 a day.

The washing up is a lot easier during the busy weeks, its quick to boil some ride or pasta to complete the meal and best of all it's not tiring :) Nothing better than a hard days at work to come home to an easy 'home cooked' 5 minute meal :)

hope this helps,

Cheers,

A

  • 2 weeks later...

I do something similar myself, we are very busy in this house & with kids to feed it is a great way of teaching them to cook. My daughter loves being in the kitchen with all the meals to prepare with daddy. I find it really helps with getting her to eat vegetables & all the other stuff kids think is yuk. She has started to plan meals for the week & my wife loves the fact she can leave us to it. I look forward to me & my daughter just spending time together & she is learning & having fun, she even makes shopping lists for the stuff we will need for the Sunday cook, Great fun.

Seems to be a good routine but personally I would not be disciplined enough to really do it myself. Although it is certainly a good way of saving money. But do you really need to get up at 5am, I mean 7 or 8am would still do

firstly you gotta peel and boil vegeies, then cook/grill/fry all your meats for your different meals at the same time(how big is your oven) I guess its good to get it all out the way at once, but the concentration would drive me mad. Im like Ramsay in the kitchen except Im swearing at no one cos im usualy alone!

I get up at 5am by habit :) But the better side of it is that I catch the end of the Eco7 electric, so I save an extra penny too.

The joy with one pot meals is that you dont really need to babysit them whhen they're on the go. After you've started them off, more times outta none you leave em slow cooking on their own :) Just be sure to put the buzzer/bell on to remind you they're there!

@Roxie: haha I'm the same when it comes to cooking pasta dishes :D FOr some bizarre reason I'm ultra finicky about how they're done and I usually end up swearing at myself (oddly enough in Italian)!

@snowy: that's how I started to like cooking :) When I wa a kiddo, I used to help my mum out in the kitchen and picked up an affinity for the cooking realm :) THere's nothing I find more therapeutic than preparing a simple meal :)
