morning everyone i have compiled my letter asking for my charges to be refunded and when i went on line they charged me a further £25.00 is this ever going to end so i had to do another letter (hadnt sent that one out yet), so in this month alone they have charged me £75.00!!!! which keeps taking me overdrawn i dont have an overdraft omg!
anyway i have telephoned requesting a refund previous and was promised a 50% refund im still yet to see that!!!!
so this morning im going to my local branch where i will hand deliver the letter and ask for a reciept of receiving, my total im claiming for over a 6 month period is £117.00 now i do appreciate i should keep a better eye on my finances " i did" on every occasion they charged me in the morning by end of day there were sufficient funds to have put me nicely in the black im so annoyed and i just dont have the funds to afford this much this month in charges!

morning i have just checked my account online this morning and they have issued more charges due on my account for tomorrow (sunday 8th oct) for august - sept period!!!! this will yet again take me over drawn! so im now going to have to go with out food this week in order to put in the 25 quid so i dont go overdrawn!!! im selling on ebay but i havent received my payments yet im totally annoyes as i have sent recorded delivery my prem letter which they have ignored and now im going to have to send it again including these charges, which i will do today flamming A&L!!!
i have decided that i am going to transfer all my dd to my shadow account on monday and get my wages paid in there totally miffed!

When the Liberals and Conservatives were in opposition they both agreed that banks should pay back high bank charges to customers. Nothing seems to of happened since they came into power as a coalition. PPI insurance has been sorted now they should turn their attention to bank charges and help customers get exorbitant charges refunded.

Klare, by my calculation you can give them until Wednesday to reply to your prelim request, then go ahead with the lba if they haven't agreed to pay up.
You don't need to tell them of the new amount you are claiming, I don't think many claims would actually get to court if people had to start again every time there was a new set of charges to add!

sorry im so down today yet again they have slamed a further £54.00 onto my account its crippling me financially, i have compilied a prem letter of which they totally ignored and since then have charged me further so i have compilied anoth last night with the most current and upto date charges
i just cant keep this up im tired and depressed and tehy are really crippling me everyweek its gettimg that they are slamming charge after charge i can not affor to live
im so depressed i will today contact my DD payees and cancel them to change my account over to my CO OP account and start again before this finally tips me over the edge

Write the lba and send that also inform them that any charges will be added to the amount claimed, Speak to the customer services manager at head office inform him of your plight you never know they might be understanding. Also you could alway tell them you ar egoing to inform teh press. Dont be sad just think of the day when you get your cash back.:grin:

dont dispair, just think of the day you are laughing at them, they will pay it back, just takes time and a bit of nerve, they are hoping to scare you off...........
its not easy thinking that you have a bit of money available and then wham, its taken in charges. but eventually you will win, we were in your position in the start of the year but then i heard about this site and now i have no debt at all.

don't let it get you down,i know it's hard to deal with when they just snatch your money but remember "they are doing it and it is unlawful" .as livelylad says you are amongst friends here.we've all been there and we've all decided enough is enough.send your lba ring them and talk to them but most of all decide to go on the offensive against their unlawful practices and get your money back.

Do you have someone, a friend, family, who could be with you right now? You shouldn't be on your own when you're feeling that unhappy.
Big cyber-hugs from me here anyway, you are not alone, you have 80 000 people just on this site who have all, at one point or another, been in the same boat (it's a damn big boat ;-))
I know how hard it is, when you feel that there is no stopping the flow, they are relentless. But listen to me, you can take steps to make it stop, at least temporarily.
You have another account, that's good. You are absolutely right in cancelling your d/ds. But don't start new d/d on your other account. D/d give them the right to help themselves to your money, however much they want, when they want, it gives them all the power, and you none of the advantage.
Before you do all that follows, make sure that your incoming money gets transferred to Co-Op from now on. If it's benefits, tell DWP asap. If it's wages, tell your payroll people asap.
Set up Standing Orders instead. They work in the same way, except that you call the shots. YOU say when, YOU say how much. Combined with Internet Banking, s/o are the most powerful way to get control of your finances, IMO.
This is what you need to do, if you haven't yet. YOu need an accounts book, just a plain old lined A4 Poundland jobbie will do. From now on, it will be your bible. ;-)
I am going to work on the assumption that you have Internet Banking, if you don't, set it up asap, both on the A&L and the Co-Op account.
Either way, you need to get a bill for every one of your d/ds. Some companies are already clued on the internet thing and at the back, will give you the details on how to set up online payments. Those who don't, you'll need the payment slip, it has a sort code and an accoutn number, that's what you need to set up online payment, with your own reference number. Sort out the amounts and dates so that they coincide with your incoming money, paying attention to due dates on credit cards and so on.
Write down in your book all the reference numbers, sort codes and account numbers, in case you ever need them again.
Once it's all set up, cancel the d/ds with A&L. Contact the relevant companies like insurances and so on to tell them that you are changing banks, and that normal service will be resumed. On things like electricity, gas, insurances and so on, they are usually quite flexible on the payment dates, so you can change the payment date to one that suits you better, make sure you tell them when you phone them.
You have now taken the first step to take control of your finances. You will have to monitor it daily, and you will have to learn to juggle around, but it can be done. I am not good with numbers, but if I can do it, anyone can.
Now both your income and outgoings are going through Co-Op, you are left, presumable, with an A&L overdraft. That's ok, that can be dealt with too. You need to work out how much of it is made of charges, how much is it you would actually owe if it wasn't for the charges, and take it from there. Remember, once they no longer have first access to your money, they can add all the charges they want, it is no longer a major issue. OK?
If the bank tells you to repay the overdraft in full, don't panic.
Work out how much you can repay per week/month without leaving you in financial dire straits. Write to the bank telling them that you can not possibly repay the o/d in one go, and that you will pay back £xx per wk/mth/4 wks/whatever until o/d is cleared. Enclose 1st payment in letter. If they cash the cheque, it will be all the harder for them, in the case of future argument, to explain why, if they didn't accept the agreement, they cashed the cheque. You need to say in your letter that this is the best you can do, and if they are not happy with it, they can and should take you to court and ask a judge to decide what and how much you should repay. Oh, and demand that they freeze interest onto the debt until it is paid off. (they probably won't, but it is aways worth a try)
Here's the news: The bank doesn't want to go to court on that either, for the following reasons:
a) Like the rest of us, they have a duty to mediate outside the court sytem. If you have made a reasonable offer, a judge will not take kindly to them litigating.
b) Depending on what you offered to repay and what your existing debts are, a judge could well decide to award them LESS than what you have offered to repay in the first instance. Because a bank o/d is not a "necessary" debt, it is at the bottom of expenditure, and before a judge decides how much you should repay the bank, he'll look at all your other outgoings, mortgage, food, electricity and so on... Then, on a sliding scale of importance, until it gets to the overdraft... And since you had made an offer of repayment as it is, and kept to it, he is not going to put the bank very high in the order of priority. And the bank knows this.
The 3 important things to remember are these: Enclose 1st payment with your proposal. Keep up the payments. Don't budge once you have made your proposal, no matter what they say.
In all likelihood, when you win your charges back, they will pay them againt the o/draft. Fair enough. Think of it as one less debt hanging around your neck on the way to financial recovery.
It can, and will, get better. You're in a place right now where you find that hard to believe. But you can do it.

I think I read on here somewhere that a bank can't close an account or demand repayment of overdraft if the account is in dispute. Please correct me if I'm wrong as I'm new to this.
