N39 was personally served to the defendant and I received a certificate of service from the process server, do I just need to now file that with the court ?.

What is he currently paying you and how much of the debt is left?

If I believe the defendants details on the record of examination is incorrect or not true, how should I address this issue ?.

One example of incorrect information is he has claimed his son of 25 is a dependant child, how could this be ?, the other thing is as the defendant was questioned by court staff and not a judge as my request, could the defendant still be liable for lying ?.

It's possible that he misinterpreted the meaning of the word "dependant."

What proof do you have that the son isn't dependant? Do you somehow have his medical background? Or is it as simple as he doesn't even live with her?

I'm not even sure If a redetermination is an option of what I could do and phoning the court waiting for someone to answer is exhausting and relying on the Internet for accurate information is not always sensible but hey ho.

Not necessarily as not all disabilities are visible, so just because the son seems perfectly "normal" to you doesn't mean anything at all I'm afraid. I stress I am purely speculating there but please consider things like Epilepsy, Autism Spectrum Disorders, Crohns Disease, Schizophrenia as they all can be classed as Disabilities but not always visible by ones eyes.

Is it an N244 for an application for an amount to be considered for in increase ?.
