Hi
I am new to this and have just gone through my husbands statements and want to claim £2555. He has an overdraft with them and just want to know whether they are likely to remove this once I send the letter (even if I will use the money to pay it off), and if I should get his salary paid into a different account.
Any advice helpful.
Many thanks
Sam
Before you start please have a thorough read of the FAQs (there’s a Step by
Step guide here too). You should print both of these out to refer to, so as to avoid having to ask basic questions later.
Then look at other threads in your bank’s forum, so as you know what you can expect to happen
You need to spend 2 or 3 days gradually getting your head round everything. If you find a forum/thread/post of interest, save it in your Favourites, so as you can always find it easily.
There’s a lot to take in, but it’s time well spent and will ensure that you succeed in your claim without problems. Remember it’s not a race, don’t rush, just follow the guidelines one step at a time
This is a self-help forum and you must be prepared to put in time and effort. It is your claim, your money and you cannot expect others to do all the work for you.
When you feel confident that you understand the process and the various stages involved, start a new thread in your bank’s forum and post your progress and any questions there and you’ll get plenty of help
I've just received a letter from the bank offering me £1000 towards my claim of £2555. I am going to reply but want to check which letter I should use - the letter before action, or the response to settlement letter - any advice please.
Thanks Sam
If this was a response to your preliminary letter then you need to send your lba, it would be best to accept this offer as part settlement only and point out that you will be persuing the remainder of the claim, through the courts if need-be.
It would probably be a good idea to remove the first line of this letter and replace it with:-
Thank you for your letter dated xx/xx/xx
I respectfully decline your offer of settlement and request, once again, that you return to me all charges imposed on this account, totalling £xxxx
I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a county court claim if necessary.
