got a letter this morning offering me £995 to settle
my claim was for £1150 tho
the letter says
hcbc,s interest rates are well publicised in respect to both authorised and unauthorised overdraughts . you have asked us to refund over draught interest on your account. it is of course a condition of your borrowing from us that u will pay interest at the agreed rates on that borrowing .As such we will not be refunding the interest that has been aplied to your debt .
what should i do now ?
the interest was only £40 so the offer is still £100+ short of what theyve taken off me
I woudl take the view that they have charged you a proprtion of interest on penalties they have unlawfully applied.
It does seem a small amount of money, have they made the offer following issue of a claim/ mcol?
An option would be to file a claim if you are nto happy with the offer, that way you can apply the 8% interest.
Seems a little short sighted of them to adopt this stance as they must realise they stand to have to cough the court fees and the interest.
Oh well just a little bit less the shareholders get to play with.
