Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I started my claim sometime in April seeking to claim £450 pounds worth of charges. I kept to the timetable and reached the point where they offered me £125 'as a gesture of goodwill'. However this is where it falls apart after recieving the letter on 16 of May and given eight weeks to responed i moved house and started a new job and lost the orginal letter!! After moving and realising the letter was missing i attempted to have a re-print sent out, which Barclays said they couldn't find and last month they found it. I promtly called Karl Voller/his PA and told them that i was refusing the offer and would claiming for the full amount plus interest via the small claims court.
That's my story so far what i'm asking is whether the delay will hinder my chances when i go to court. I haven't filed my case yet and was waiting for advice before i went ahead. Your help and or advice would be greatly appricated thanks...
Re: Mallinson vs Barclays (timetable gone belly up)
I would write another letter before action, giving them 7 days to comply and then file small claims, you have already given then the time you should have but just to refresh their memories and to re iterate the fact you are willing to try and settle this out of court another letter before action would be a good idea!
Re: Mallinson vs Barclays (timetable gone belly up)
